Officer :Glen Conforti Direct Telephone: 07 53296241 Our Reference :MCU16/0144 Your Reference :N/A 22 December 2016 MA McFarland C/- RG Strategic PO Box 1818 NOOSA HEADS QLD 4567 Dear Sir/Madam Information Request Sustainable Planning Act 2009 I refer to your application and advise that Council requires further information to satisfactorily assess the proposal. application details Application No: MCU16/0144 Proposal: Development Permit for Material Change of Use of Premises - Retail business Type 2 - Shop Street Address: 1 Kingsgate Dr TINBEERWAH QLD 4563 Real Property Description: Lot 63 RP 200339 Planning Scheme: The Noosa Plan (28 October 2016) information required The information requested is set out below: Issue - Use The Planning Scheme specially identifies the subject site for Retail Business Type 1 – Local which would provide convenience shopping for the surrounding rural residential areas. The submitted planning report has not sufficiently justified why there is not the need/demand for a general store to serve the local hinterland community. Information Required Please provide further discussion justifying the proposal without a general store component. Issue – Car Parking The applicant has not demonstrated that on-site parking arrangements are in accordance with current standards and are sufficient to address the demands generated by staff, customers of the shop and the take away component of the use. The proposed 99m² gross floor area attracts a minimum of 5 spaces as outlined by Driveways and Car Parking Code Probable Solution S7.1. However, this is a minimum and considered not to meet the corresponding Specific Outcome O7 which seeks that car parking is provided on site to accommodate the number and type of vehicles likely to be generated by the development. Under the current arrangement (10 chairs and take away) there is evidence that patrons are utilising off site car parking areas. Information Required Provide additional detail that: demonstrates that the existing sealed on-site parking area is in accordance with current standards defines the number of on-site spaces for staff parking area defines the number of on-site spaces for the take away food defines the parking and access for the residential uses provides additional car spaces on site suitable for the use Issue The site currently has a number of unapproved and non-standard access points and a non-standard informal carparking area. Information Required Provide preliminary plans that detail: The works to be undertaken on the informal carparking area within the site and in the Kingsgate Drive road reserve to reinstate/revegetate the area and the reinstate original surface levels/drainage patterns The works to be undertaken to improve the second access in Kingsgate Drive to be in accordance with current standards The works to be undertaken to improve the informal access in Sunrise Road The location/extent and formation of the staff parking area, and The areas for the take away customers Additional car parking on site for diners. Issue - Noise Existing off site car parking arrangements has the potential to adversely affect the surrounding area in regard to noise from vehicles and patrons. The acoustic report prepared by Road Pro Acoustics is somewhat deficit in that it does not discuss alternatives to reducing car park and patron noise impacts on surrounding residential areas. Information Required An amended acoustic report prepared by a suitably qualified person should be submitted to Council addressing the following: an alternative car park area for patrons/take away patrons/staff that would lessen the impact of car parking and patron noise on the affected residential area(s) and the acoustic treatment of any alternative car parking area. alternatives to the removal of chairs/tables from the veranda and closing the dining area windows on the Kingsgate Drive frontage during patron usage. Alternatives may include(but not limited to) – appropriate acoustic treatment of the building and any outside eating areas to contain patron noise such as enclosure of veranda areas etc fixing of windows and openings and installing mechanical ventilation relocation of dining areas etc predicted intrusive noise levels following alternative acoustic treatments etc. Intended/actual hours and days of operation Issue - Toilets The food business should ensure that adequate toilets are available for the use of food handlers working in the business. As this is a change from a convenience store to a food use, the applicant is to demonstrate that toilets are adequate. Information Required Provide written advice from a registered building certifier that toilets for staff and customers are adequate in accordance with the Building Code of Australia or other relevant industry guideline. Consideration should be given as to whether the applicant has/will be seeking a liquor license. It is recommended a meeting with Council to discuss the information request items is arranged.
