1. PROPOSAL
The applicant seeks Council’s agreement that the following changes are generally in accordance
(GIA) with the approved plans of development for the site:
• The applicant has requested that two awning additions are GIA;
Unit 1 – awning approx. 4.8 x 4.0 metres in dimension; and
Unit 2 – awning approx. 4.8 x 3.96 metres in dimension.
2. BACKGROUND
A development approval for a Group Housing Development (51 units) TPC 2477 (TPC) was
approved by Council on 17 December 1992. The TPC includes Approved Plans 9220SK01, SKO3,
SKO5, SKO6, SKO7, SKO8, SKO9 and SKO10.
The site has been developed and continues to be used as a residential development in accordance
with the TPC and approved plans.
3. ASSESSMENT
3.1. Instruments for Statutory Assessment
The following codes from the Noosa Plan 2020 are applicable to the proposed changes:
• TPC 2477;
• Medium Density Residential Code;
The below approved plan excerpt (from SKO6) indicates a minimum canal setback of 11.5 metres
for the north west units. Units 1 & 2 would be setback approximately 12 / 13 metres.
The original TPC2477 officer’s assessment states that the planning scheme provisions in force at
time of the approval allows for a minimum setback to the canal of 6.0 metres and site coverage of
40%. Approved plan SKO6 for the 51 units states a site coverage of 25%.

For this GIA proposal, site coverage and setback from the canal would not encroach into the
minimum 6.0 metre canal setback or exceed site coverage parametres under the TPC.
There is potential to receive ongoing applications for awning extensions for other units within the
complex which may collectively exceed the development parameters under the TPC and approved
plans.
It is recommended that an advice notation is included with this GIA which requires an updated
development schedule to be prepared and maintained by the Body Corporate to be submitted with
any future applications for Council’s review and record.
The development is considered generally in accordance with the development permit.

generally in accordance with the approval. The proposed development generally complies with the
requirements of the planning scheme and does not raise any significant issues that cannot be
addressed by reasonable and relevant conditions. The generally in accordance request is therefore
recommended for approval.
The report is provided in accordance with Section 63(5) of the Planning Act 2016.
RECOMMENDATION
With regard to Application No.51992.539.01, seeking confirmation that the proposed changes are
considered generally in accordance with the development approval TPC 2477 for - Generally in
