Dear Sir/Madam,
Further Advice
Planning Act 2016
I refer to your application and advise that Council provides further advice with regard to the proposal.
application details
Application No.	RAL19/0014
Street Address:	30 Pottery St Pomona Qld 4568
Real Property Description:	Lot 496 MCH 591
Planning Scheme:	The Noosa Plan (8 June 2018)
INFORMATION REQUIRED
The further advice is set out below:
Issue - Pedestrian Pathway
The proposal plans do not detail a pedestrian pathway to the full length of the new road to the cul-de-sac head.
Information Required
Provide amended proposal plans that detail/annotate a pedestrian pathway to the full length of the new road to the cul-de-sac head.
Issue - Bio Basin Design
The reason provided for the proposed retaining walls does not meet Specific Outcome O8 of the Water Sensitive Design Code*. The submitted information and design have not demonstrated whether any alternative stormwater treatment trains have been considered – e.g. There is an opportunity to provide additional treatment swales/trains to treat runoff from the road and some of the allotment, this could likely reduce the size of the proposed basin required at the southeast corner of the site and prevent the need for retaining walls for the basin.

*O8: Development design including density and scale provides adequate footprint to integrate all elements of stormwater quality and quantity treatment infrastructure including, where relevant, bio retention basin batters and maintenance access, without the need for retaining walls.
Information Required
The above issue may impact on the proposed layout for the subdivision and needs to be clarified prior to the final determination of this development.
Issue - Stormwater Pipeline Alignment
There is no reasonable justification for the alignment of the proposed stormwater pipeline near the front boundary along Pottery Street, rather than the standard corridor that is generally adjacent the proposed kerb line. The proposed alignment restricts future maintenance access to the stormwater pipeline and may adversely impact on existing trees within the road reserve, which can be preserved.
Information Required
The final stormwater layout and design will be assessed and approved in the OPW application stage. However, this aspect must be considered and planned appropriately at the current RAL stage.
Issue - Bushfire
Lots 8-10 are proposed within a radiant heat flux of greater than 29kW/m2, with dwellings setback to achieve less than 29kW/m2. The application proposed to use building methods to mitigate risks associated with development in a bushfire hazard area. The Natural Hazards Overlay Code seeks the proposed lots are sited on land determined as low bushfire risk by a site-specific bushfire hazard assessment. The material provided demonstrates Lots 8-10 are not located in a low bushfire risk site and are located in a “tolerable” risk area.
Information Required
Demonstrate the lots are located in an acceptable risk or low hazard area within the bushfire hazard overlay area.
Issue - Bushfire
Asset protection zones (APZ’s) are proposed to the western lots. No detail is provided on how those APZ’s will function in perpetuity. Residential activities in the back yards, such as garden beds, cubby houses, sheds and other structures can compromise the APZ’s in the subject property and neighbouring properties.
Information Required
Provide a legal mechanism that secures the APZ’s management in perpetuity.
Issue - Bushfire
Emergency vehicle access to the covenant area for bushfire control could be impeded by buildings, structures and the like following the development of lot 8.
Information required
Demonstrate how emergency vehicle access will be provided to the covenant area in lot 8 and protected in perpetuity.
due date for response to further advice
You are advised to stop the current period to allow sufficient time to provide a response to Council’s further advice, otherwise the application will be decided in its current form.
