GENERAL COMMITTEE MEETING AGENDA 17 MAY 2021
AO6.1
Development and clearing of vegetation does not occur within:
a. a riparian buffer area;
b. a wetland area; or
c. 10 metres either side of the centre line of other waterways identified on a Biodiversity,
Waterways and Wetlands Overlay Map.
AO6.2
Development provides for the rehabilitation of land within:
a. a riparian buffer area;
b. a wetland area; and
c. 10 metres either side of the centre line of any other waterway identified on a Biodiversity,
Waterways and Wetlands Overlay Map.
The following images detail the mapped waterway and the proposed development in this area. The
images identify that the proposed development is generally located outside the mapped riparian
buffer area, with the riparian buffer area to be included as drainage reserve and therefore does not
overtly offend the Noosa Plan 2020 as the waterway’s function is largely maintained.
Figure 6 – Mapped waterways (Noosa Plan 2020) and proposed lot layout
However under The Noosa Plan 2020, this area would be required to be rehabilitated to a level and
extent that would not typically be required under the SPS for a drainage reserve.
The Noosa Plan 2020 also seeks that no development occur within 10 metres of a waterway and
that 10 metres either side of a waterway is rehabilitated. Compliance with this requirement has the
potential to impact on lot 4 and the proposed lot layout. However preliminary review indicates that
the waterway is in a deteriorated state and contains sewerage infrastructure and so may have limited
impact on the number of lots able to be achieved.
Furthermore Acceptable Outcome AO8.1 the Biodiversity, Waterways and Wetlands Overlay code,
seeks that no new lots directly back onto a riparian buffer area and for new public roads to be located
between a riparian buffer area and the proposed development area. Whilst the proposed layout
includes a lot which abuts the riparian buffer it is unlikely to be reasonable to provide a public road
for the full length of this riparian buffer.
The requirements of the Landslide Hazard Overlay would have little impact on the proposed lot yield.
