Previous Council Consideration
The matter has not been previously reported to Council but the following is noted for Councillor’s
information:
     A superseded planning scheme request was lodged with Council in 2021 to permit the use of
      the property for short term accommodation. This request was refused under delegation by
      Council officers.
     An application for Short Stay Letting has been lodged under the new Local Law. This
      application had not been decided at the time of preparing this report to Council.

Finance
It is not yet possible to provide an accurate estimate of what this litigation will cost Council. That will
depend on a range of variables including expert costs, the extent to which the litigation is contested
etc. The ongoing cost can be monitored through the Case Management Working Group. It should
be noted that Council’s legal costs are currently within budget.

Risks & Opportunities
Any litigation has risks associated with the outcome. Nevertheless, pursuing court action will support
residents whose amenity is currently being adversely impacted by this business. It also maintains
the integrity of the Noosa Plan 2020.
