         Attention: Lisa Pienaar

Dear Lisa,

INFORMATION RESPONSE - DEVELOPMENT APPLICATION FOR A MATERIAL
CHANGE OF USE (DWELLING HOUSE) AT 24 PLOVER STREET, PEREGIAN
BEACH (LOT 5 ON P9313)

Further to Council’s Information Request issued 1 March 2022, we now respond in full to each of the
items raised.

In support of this response, please find enclosed:

    ●    Revised Proposal Plans prepared by Aboda Design Group;
    ●    Preliminary Stormwater Management Plan prepared by Westera Partners;
    ●    Letters of support from adjoining neighbours;
    ● Stormwater Management Report prepared by Westera Partners.

Please find below the response to each of the items raised by Council:

Item 1

Submit amended plans that show all RL’s to the top of all proposed structures.

Response: The Proposal Plans prepared by Aboda Design Group have been revised to show all RL’s to
the top of all proposed structures.

Item 2

Provide additional section plans that clearly show all deck heights.

Response: The Proposal Plans prepared by Aboda Design Group have been revised to show all deck
heights.

Item 3

Provide amended plans that comply with Acceptable outcome AO7.4 and Performance
outcome PO7 (f) and Performance outcome PO7 (a), (b), and (c) and Acceptable outcome
AO7.2.

Response: Please refer to the amended Proposal Plans prepared by Aboda Design Group, which includes
a Architectural analysis and comparison of two versus 3 storey built form. The analysis confirms that the
inclusion of a third storey is of no consequence to the built form in terms of bulk, massing, scale, privacy,
views or overlooking. The proposal complies with PO7 in the following ways:

    ● PO7(a): the proposal is within the 8 metre height limit and is consistent with the existing built
         form surrounding the site;
    ● PO7(b): the proposal provides architectural finishes and treatments to ensure a high quality finish
         to the streetscape.
    ●    PO7(c): the proposal presents as two storeys from the street frontage;
    ● PO7(f): whilst the proposal exceeds two storeys for a small portion of the built form, the
         Architectural analysis provides evidence there is no greater visual impact on either neighbours or
         the street view by having a third consecutive level.

Item 4

Provide amended plans that comply with Acceptable outcome AO5 of the Coastal Protection
and Scenic Amenity overlay code.

Response: Please refer to the amended Proposal Plans prepared by Aboda Design Group. The extent of
the pool deck to the east of the pool has been decreased to what is existing. Landscaping is maintained
along the rear boundary, which includes a mix of turf and native landscaping.

We note that the site is mapped as containing medium bushfire hazard areas and medium potential
bushfire intensity. Providing a 5m vegetated landscape strip along this boundary provides an increased
fire risk to the subject site.

Item 5

Submit amended plans that remove decks close to the side boundary and reduce fence
heights to a maximum of 2 metres from natural ground.

Response: Please see attached letters of support from adjoining neighbours and the revised
Architectural Plans prepared by Aboda Design Group. The southern built-to-boundary deck will remain as
originally proposed, however the northern built-to-boundary deck has been amended to provide a 600mm
wide landscape strip. Fences B and C in particular are necessary as the southern site is elevated higher
than the subject site and the fence along this boundary assists in mitigating privacy concerns of the
residents and their visitors.

Item 6

Submit amended plans that comply with AO9.4 of the Low Density Residential Code (a) (ii)
and Queensland Development Code (QDC) A2 (d) (i).

Response: Please see attached revised Architectural Plans prepared by Aboda Design Group, which
demonstrates the mean height of the built-to-boundary garage is 3.309m, and therefore achieves
compliance with the Queensland Development Code (QDC) A2 (d) (i).

                                                                                                           2

Item 7

Provide amended plans that address the loss of mature vegetation in the road reserve.

Response: The existing paperbark trees in the road reserve are in poor condition and will be replaced.
This has been conveyed to the adjoining owner to the south via a letter of support, which is attached. We
request that this is appropriately conditioned.

Item 8

Demonstrate how vehicles accessing/egressing the subject property can do so in a forward
gear.

Response: Noosa Plan’s Driveways and Parking Code requires that “vehicles enter and leave the site in a
forward gear, excluding dual occupancy or detached dwellings on local roads.” As the proposal is for a
dwelling house, this is not considered applicable. Plover Street, whilst considered a major road, is still a
local road. Proposing a turnaround area for vehicles to enter and exit the site in a forward manner would
result in excessive hardstand area that would provide a low quality streetscape outcome.

Item 9

Detail if any vegetation on road reserve is proposed to be removed, and if so, provide
amended landscaping plans including vegetation on road reserve on a 2:1 ratio (i.e. 2 new
street trees for any tree removed).

Response: See Item 7 above.

Item 10

Provide a site specific geotechnical report and site stability assessment for the site and
development. The report must include, but not be limited to:
     a. recommendations for the construction and operational phases of the development
        to ensure the stability of the subject site and the adjoining properties for the longer
        term;
     b. details of the proposed structural solution to protect the structural integrity of the
        existing sewer infrastructure running along the site’s eastern boundary;

Response: The proposed extension is largely within the existing building footprint. We request that this
item is conditioned to be addressed by a building certifier.

Item 11

Provide Unity Water’s approval for the proposed works over and adjacent to the existing
sewer line.

Response: In light of the plan amendments, no works are proposed over the Unitywater sewer line.

Item 12

Provide a preliminary stormwater management plan for the proposed development. The
management plan must include but not be limited to:
     a. the structures for both the construction and operational phases of the
        development;
     b. be consistent with the site specific geotechnical report recommendations; and

                                                                                                          3

      c. demonstrate that the runoff from the site is suitably controlled to ensure that the
         downstream environment is not adversely affected or destabilised.

Please note that the stormwater drainage system must be a gravity system and pumps are
     not acceptable.

Response: Please refer to the attached Stormwater Management Report prepared by Westera Partners.

We thank Council on behalf of the applicant for assessing the attached additional application material.

Based on the information provided in this application we respectfully request that Council proceed to
issue an approval.

Should you have any questions with respect to the above, please do not hesitate to contact me directly.

Yours faithfully,
Adapt Town Planning + Development Management
