PLANNING & ENVIRONMENT COMMITTEE MEETING AGENDA 7 FEBRUARY 2023
6. The development complies with the Noosa Plan or the Council has determined that there are
reasons why the development should be approved despite any conflict with the assessment
benchmarks, in accordance with section 63(5)(e) of the Planning Act 2016.
The proposal meets the circumstances under which a monetary contribution might be considered
as the land is significantly constrained being small in area and it is not practicable or desirable to
require on-site parking from a character perspective given the manner sites with frontage to the
village square have developed.

4.3 Public Notification
The application was not required to be publicly notified in accordance with the Planning Act 2016
given the application is required to follow a code assessment process.
5. CONCLUSION & REASONS FOR DECISION
The applicant seeks approval to renovate and extend the existing commercial building on site and
create a two storey building that will comprise shops, offices and food and drink tenancies. The
proposed uses are consistent with the zoning intent for the site and the building form incorporates
a range of materials and finishes that are consistent with the contemporary coastal built form of
the area.
Whilst the building generally meets Planning Scheme requirements it does not comply with
carparking, landscape open space and setback requirements. The proposed areas of non-
compliance are considered acceptable due to the small area of the site, the existing built form of
the area and the provision of an infrastructure agreement to address carparking contributions.
