EXECUTIVE SUMMARY
Not applicable.

RECOMMENDATION
That Council note the report by the Manager Development Assessment to the Planning &
Environment Committee Meeting dated 12 June 2018 regarding Planning & Environment Court
Appeal No. 1302 of 2018 and the proposed settlement.

REPORT
This report is to provide an update to Council on an appeal received against an Enforcement
Notice issued to the developer for clearing vegetation on the road reserve adjacent 105 Resort
Drive, Noosa Heads.
In February this year Council received complaints in relation to clearing of vegetation on the road
reserve adjacent to 105 Resort Drive, Noosa Heads which is currently being developed for
multiple dwelling units.
Inspection of the site by Council officers confirmed that clearing of vegetation had occurred on
the road reserve adjacent 105 Resort Drive contrary to the conditions of the Development Permit
for Operational Works – Earthworks. The species removed from the road reserve included 4
Brush Box and 1 Bribie Island Pine, all reasonably mature native trees. The development
approval requires earthworks to be carried out in accordance with a number of conditions
including specifically relevant conditions 1, 3, 32, 33, 34 and 35 as follows:
1. Development undertaken in accordance with this approval must generally comply with the
approved plans of development. The approved plans are listed in the following table unless
                         otherwise amended by these conditions.
