PLANNING & ENVIRONMENT COMMITTEE MEETING AGENDA 12 JUNE 2018
The developer further advised that “although we feel that we acted in good faith in seeking to
comply with Council’s development approvals, we recognise that a breakdown in
communications and inconsistencies in the hierarchy and interplay of approved plans and
conditions have resulted in the current problems. To avoid the potential for future
miscommunication, we have now employed a dedicated project manage…”
The developer also advised that to offset the loss of the removed trees to the community they
propose the following:
A financial contribution of $60,806 to Council to offset the loss of the removed trees. In this
regard the developer’s arborist has inspected the site and the location of the trees and
prepared an assessment of the value of the trees in accordance with the Burnley Method.
The Burnley method is a well-established method of determining a monetary value of trees.
The financial contribution comprises $58,806 towards the value of the removed trees and
$2,000 towards Council’s administrative costs associated with the investigation.
To provide in kind assistance to undertake rehabilitation of Girraween Nature Refuge. In
this regard the developer proposes that the financial contribution would be best used in the
rehabilitation of the land in the locality being the degraded area of Girraween Nature
Refuge, which is devoid of vegetation or infested with weed species.
The developer has advised that they would be willing to provide assistance in the
establishment and maintenance of the rehabilitation area such as temporary irrigation, the
provision of clean topsoil and mulch and weed management.
To prepare landscaping plans to comply with items 3 and 4 of the enforcement notice to
reinstate koala food trees and rehabilitate the area.
The developer also filed an appeal against the Enforcement Notice advising that the appeal was
filed to preserve their interests should the proposed solution not be an acceptable solution to
Council, while reiterating their desire to work with Council to achieve a positive community
outcome.
