PLANNING & ENVIRONMENT COMMITTEE MEETING AGENDA 10 SEPTEMBER 2019

On 29 April 2019 the applicant sought confirmation that the amended plans could be considered
Generally in Accordance with the initial referral response. On 6 June 2019 SARA advised the
applicant that the amended plans were Generally in Accordance with their original referral
response. As such, the applicant is not required to make further application to SARA although it
is noted that the following was included in the SARA response.
The department would like to advise that all vessels must remain moored inside the water
allocation area as a result of the amended siting of the existing jetty and new pontoon as
per the amended plans referenced above and agreed to in this generally in accordance
       letter.

5. CONCLUSION & REASONS FOR DECISION
The applicant advises that due to a construction error, an extension to a jetty was not built in
accordance with the approved plans issued by Council. The applicant now seeks to amend the
approved plans to reflect the constructed jetty, which has been built to the lease boundary
instead of providing a 2.6 metre setback to the northern lease boundary. The location of the jetty
results in refuelling and mooring activities being undertaken outside of the commercial lease
area.
The applicants request is not supported as all activities associated with the jetty are required to
be located within the lease area consistent with the Noosaville Locality Code, the Watercourses
Works Code, the Marine Facility lease and the draft Noosa Plan.
