PLANNING & ENVIRONMENT COMMITTEE MEETING AGENDA 10 SEPTEMBER 2019

3.2. Statutory Instruments – Noosa Plan
The Noosa Plan defines an Ancillary Dwelling Unit as follows:
      Ancillary dwelling unit means the use of premises for a caretaker’s residence or employee
      residence associated with a non-residential use on the same premises where:
       There is no other dwelling unit on the premises, except where the non-residential use
            is an agricultural use;
           The gross floor area of the dwelling unit does not exceed 150m2;
           The dwelling unit is subordinate to the non-residential use;
       The dwelling unit is attached to or within 25m of the non-residential use; and
       The dwelling unit is occupied by the owner of the non-residential use or somebody
            employed in the non-residential use.
A caretaker’s residence is defined as:
      caretaker’s residence means a dwelling unit situated on the same premises as a business
      use, community use or infrastructure use where it is occupied by the owner or employee of
      the business or operation for reasons of ensuring security and maintenance of the business
      or operation.
The applicant seeks approval for 16 x 2 bedroom Ancillary dwelling units across the entire site.
Whilst it is acknowledged that one Ancillary dwelling unit for caretaking purposes may be suitable
for the development, concerns are raised as to how the multiple units conform with the Planning
scheme definition.
Specifically no information has been provided as to:
    The nature of future industrial uses on the site;
    Why these future industrial uses require multiple caretakers for security purposes;
    Why these future industrial uses requires on site accommodation for an employee;
    The role of the persons that will reside on site;
    How the caretaker or employee is subordinate to the non-residential use;
 Why 16 x 2 bedroom dwelling units are necessary for the site.
Concerns are also raised as to whether 10 of the proposed dwelling units are subordinate to the
non-residential use. Specifically the dwelling units detailed below all have floor areas that are
greater than 50% of the approved industrial use.

Unit number Ancillary dwelling unit floor Industrial floor area
                                 area
8,11,12,13,16,17,18,21,22        64m2                              80m2

Concerns are also raised as to the design of the upper level storage areas for units 9,
10,14,15,19 and 20, which are directly accessed off the internal stairs to the residential units. The
location of these stairs would not meet fire separation requirements however modification to the
plans and location of the stairs within the industrial tenancy may overcome this area of non-
compliance.
The subject site is located in the Noosaville Locality and is zoned industry. Ancillary Dwelling
units are identified as a consistent use within the zone and required to follow a code assessable
application process. The Table of Assessment for the Industry zone details that the following
code is applicable for assessment of Ancillary Dwelling units:
Detached House Code
The most relevant Overall Outcomes of the Detached House Code are detailed as ensuring that
detached houses:

                                                                                      Page 30 of 76
