PLANNING & ENVIRONMENT COMMITTEE MEETING AGENDA 11 APRIL 2017

Their assessment forms part of this report.
CONCLUSION
The application for an Operational Works Permit to develop deck additions at the T-Boat Hire
facility at 290 Gympie Terrace is recommended for refusal. The proposed works facilitate an
increase in non-marine commercial activity which will allow for the scale of existing use rights to
be increased beyond what may have accrued. The works are not in accordance with the Noosaville
Locality Code, the Watercourses Works Code or the IDAS Code for Prescribed Tidal Works.
Furthermore, the increase in commercial activity requires a Material Change of Use application
which has not been submitted and it is not considered appropriate to approve the works without
first considering a Material Change of Use application.
