PLANNING & ENVIRONMENT COMMITTEE MEETING AGENDA 11 APRIL 2017 RECOMMENDATION That Council note the report by the Development Planner to the Planning & Environment Committee Meeting dated 11 April 2017 and refuse Application No. MCU16/0075 for a Development Permit for 19 Detached houses, situated at 90 Beach Road, Noosa North Shore for the following reasons: 1. The proposed use, defined as a Detached House under The Noosa Plan is an inconsistent use in a Visitor Mixed Use zone and is contrary to the Overall Outcomes of the Noosa North Shore Locality Code and the strategic intent of The Noosa Plan, which seeks to protect substantial key sites for visitor accommodation, with the subject site identified as one of the key sites; 2. The non-protection of substantial key sites for visitor accommodation will adversely impact upon a viable tourism economy for Noosa; 3. The proposal is likely to result in poor amenity for permanent residents and may create negative experiences for visitors to the resort, given the potential conflicts between permanent residents and visitors; 4. The proposal has the potential to increase pressure to provide additional infrastructure and services on the Noosa North Shore, contrary to The Noosa Plan and Local Government Infrastructure Plan; and 5. The applicant does not provide sufficient grounds to justify the conflict with the Planning Scheme and the proposal will not result in any significant benefits to the community. REPORT 1. PROPOSAL The proposal seeks to convert existing eco-cabins previously approved for visitor accommodation to detached houses (for permanent residential living) in the existing Beach Road Holiday Homes development located at 90 Beach Road, Noosa North Shore. The development proposal is over 19 existing parcels of land and each contains an eco-cabin. The entire development site has 48 individual parcels of land, each with an eco-cabin and associated common property that contains numerous resort style facilities. The application does not include the area of land that is common property. To support their application, the applicants have lodged a Needs Assessment, Beach Road Holiday Homes, prepared by Foresight Partners Pty Ltd, 11 November 2016 which seeks to address the impact and risks of removing visitor accommodation from the visitor accommodation pool. The proposed development will not physically change the built form of the resort, with no new works proposed by the application. 2. SITE DETAILS 2.1. Background The development is part of a greater, master planned development. In October 2004, Council approved 132003.221037, a Preliminary Approval for a Material Change of Use for Development in accordance with the ‘Noosa North Shore Eco-Tourism Portal Development Code’ (Portal Code). The Portal Code allowed for a 4 stage development which supported visitor accommodation for up to 400 persons and associated services on the site. The whole master planned site is identified below as Figure 1. Page 73 of 106
