PLANNING & ENVIRONMENT COMMITTEE MEETING AGENDA 11 APRIL 2017

2.5. State and Other Statutory Instruments
State Planning Policy
The State Planning Policy has been deemed by the Minister for Local Government and Planning
as appropriately reflected in the Planning Scheme and therefore does not warrant a separate
assessment.
South East Queensland (SEQ) Regional Plan 2009 - 2031
The site is located within the Regional Landscape and Rural Production area (RLRPA) of the SEQ
Regional Plan. This designation protects land from inappropriate development, particularly urban
or rural residential development. The values of this designation closely align with the values of the
North Shore which include scenic amenity, outdoor recreation, significant biodiversity, regional
ecosystems, national and conservation parks and reserves, native forest, koala habitat and coastal
wetlands.
State Planning Regulatory Provisions
The subject land is located in the Visitor Mixed use zone (not included in the Rural Residential or
Rural zone), which for the purposes of the SPRP, is considered an urban zone. Therefore, the
State Planning Regulatory Provisions (SPRP) does not apply to this application. The intent of these
provisions is to support the diversification of rural economies by allowing development such as
small to medium scale tourist activities.
Draft South East Queensland Regional Plan October 2016
The intent of the Regional Landscape and Rural Production Area under the draft plan remains
unchanged.
2.6. Statutory Instruments – The Noosa Plan
The subject site is located in the Noosa North Shore locality and is zoned Visitor Mixed Use. The
proposed use for detached housing is identified as inconsistent use within the zone and is required
to follow an impact assessable application process.
Strategic Provisions
The strategic framework of the scheme seeks that “A Visitor Mixed Use Zone applies to the holiday
accommodation centre in Beach Road, Noosa North Shore. This site will continue to provide a
range of accommodation styles and commercial services to visitors to the Noosa North Shore area,
though limited expansion is intended.”
This is also reflected in the Desired Environmental Outcomes of the planning scheme and in
particularly in the shaded text, which is intended to provide guidance to the reader, but is not part
of the planning scheme, as follows:
“The retention of a range of visitor accommodation choices is important to the economy of
Noosa. The loss of visitor accommodation to permanent residential housing reduces visitor
choice and has a negative effect on the economy.”
“Mixing long-term accommodation for residents with short-term accommodation for visitors
is avoided because it erodes the visitor accommodation base and has potential to cause
       conflicts.”
The proposal is not consistent with the stated Strategic Framework, with the subject site identified
for use as short term visitor accommodation and those business uses needed to support visitation.
The proposal reduces the extent of visitor accommodation on the Noosa North Shore and
increases permanent residents on the Noosa North Shore.
The careful management of land use is considered to be of critical importance on the Noosa North
Shore. For this reason development and services have been specifically limited in keeping with its
remote setting, its character and its environmental sensitivity to ensure the area’s natural attributes
are protected.
