Deemed Contribution to Community Infrastructure — Private Open Space

space, and its on-going maintenance, is a commitment on the part of the Applicant of land
to meet the environmental requirements associated with the proposed development and

shall be taken to be equivalent to a contribution by the Applicant to community
infrastructure.

Future Conditions/Infrastructure Charges

Having regard to the matters Stated in Clauses 4.2 and 4.3, the Council agrees that unless
otherwise requested or agreed to by the Applicant:

(a) Applications for development approvals in respect of Future Stages on the Land
shall be immune from conditions requiring; and

(b) The Land shall be immune from future infrastructure charges or levies in respect
of

any further dedication of land, and any acquisition of other land.

DRAINAGE/WATERWAY MANAGEMENT

External Stormwater Works

Nothing in this Agreement affects the ability of the Council to lawfully impose conditions
requiring the construction or augmentation of stormwater systems external to the site in
response to applications for Development Approvals relating to Future Stages of the Shire
Business Centre.

The following design and construction standards shall apply to roadworks constructed
under this document and the Conditions of Approval:
