5.2     Assessment against the legislation

             Council’s legislation
The site is located in Rural Zone. Material Change of Use for Dwelling House in Rural zone under the Noosa
Plan is considered an accepted development subject to requirements.

The site is mapped under the Biodiversity, Waterways and Wetlands Overlay Map. An assessment against the
relevant provisions of the Biodiversity, Waterways and Wetlands Overlay Code is required (Figure 4).

An assessment against the relevant section of the Rural zone Code is provided in Table 5. An assessment
against the Biodiversity, Waterways and Wetlands Overlay Code is not required as the application is an
acceptable development.
