Dear Sir / Madam,

RE: Application for Development Approval for a Material Change of Use to establish a Transport -
Type 2 Carpark at 255 David Low Way, Peregian Beach described as Lot 95 on SP 137431

Altum Constructions acting for the Sunshine Coast Regional Council, in consultation with Sunshine Coast
Town Planning, submits a development application to Sunshine Coast Regional Council under the
Integrated Planning Act 1997. The application seeks approval! for a Material Change of Use for Transport
- Type 2 Carpark at 255 David Low Way, Peregian Beach.

This letter details the proposal and provides an assessment of the relevant code provision contained
within The Noosa Plan.

1. THE SUBJECT SITE

The subject site comprises an existing lot which is described as Lot 95 on SP 137431. The subject site
has an area of 1,812m2 and is level. The site is currently afforded direct access from David Low Way via
a sealed driveway crossover.

The site is included in the Eastern Beaches Locality and is zoned Community Services under The Noosa
Plan. No Overlays or Other Attributes are applicable to the subject site.

The site is generally vacant, however a small glass bus shelter is located in the northern corner. A
number of service easements traverse the site, including stormwater, sewer and overhead electricity
lines. A Survey Plan prepared by Downes Survey Group is included as part of this submission.

The subject site has been subjected to a 100% UXO search and remediation during which no significant
finds or Explosive Ordnance Waste was found. A report prepared by Milsearch Pty Ltd is included as
part of this submission. A copy of this report has been forwarded to the Queensland Department of
Environment and Resource Management requesting the site be removed from the UXO Management
Advice area.

2. SURROUNDING PREMISES

The subject site is surrounded by a mixture of community and recreational uses. To the south of the site
is located the Peregian Beach Bowls Club. The west of the site is adjoined by a beach volley ball playing

area. Adjoining the northern property boundary is the Peregian Beach Community Centre which is
currently under construction. The purpose of the proposed application is to provide a parking facility to
services this use, and as general public car parking.

3. THE PROPOSAL

This application seeks a Development Permit for Material Change of Use for Transport - Type 2 Carpark.
\t is proposed to establish the following:

e 35 grass car parking bays, including one disabled car parking bay;

e eight motor scooter parking bays and a bicycle storage area;

e four, future proposed 30,000L garden irrigation reservoirs;

e landscaping throughout the parking area;

© pedestrian access through to the adjoining bowls and volley ball facilities.

\t is proposed to retain:
© asmall clump of Banksia species located in the north western corner of the site;
e the existing vehicle crossover point from David Low Way; and
e the existing bus shelter.

Plans prepared by Sparks Architects detailing the proposed work on site are included as part of this
submission.

A stormwater line is currently traversing the site. An existing pit will be re-configured adjacent to the
vehicle cross-over area. A plan prepared by SCG Consulting Engineers is included as part of this
submission details the Operational Works proposed for the site.

It is noted that no structural elements are proposed as part of the subject application, and plans have
been provided which address traditional Operational Work code requirements. Accordingly it is formally
requested that Council waive the need for a further Development Application for Operational Works
(landscaping, stormwater management, erosion & sediment control and car parking & driveway access)
as this assessment requirement has been fulfilled in the subject application.

4. ASSESSMENT

The Noosa Plan includes the site in the Eastern Beaches Locality and provides the site with a Community
Services Zone. The assessment table for the Community Services indicates that a Transport - Type 2
Carpark is a consistent use and is code assessable development.

The codes identified in The Noosa Plan as being applicable to code assessable development for the
proposal are the:

e astern Beaches Locality Code

« = Infrastructure Code

e Landscaping Code

e Engineering Works Codes.

Page 3

Below is an assessment of the proposal against the relevant sections of these codes.

4.1 Eastern Beaches Locality Code

Given the large areas of landscaping surrounding the proposed parking facilities the proposal complies
with the Overall Outcomes for the Eastern Beaches Locality and those specifically identified for Peregian
Beach. Relevant Specific Outcomes and Probable Solutions are summarised in the table below.

$11.3 Car parking and manoeuvring areas are
constructed at a level that permits the parking area to
drain from the site by gravity means, without the need
for mechanical pumping;

As demonstrated on the plans included as Attachment
C, the site is able to be drained by gravity methods
towards David Low Way, and therefore does not
require mechanical pumping.

O66 Council owned land located on the corner of David
Low Way and Woodiand Drive in Peregian Beach is
developed for a multi-purpose community centre
providing for a range of sporting, recreation and social
uses to serve the needs of the local area.

As the proposed car park is intended to service the
parking needs of the adjoining Peregian Beach
Community Centre (currently under construction) it is
considered that the proposed complies with this
Specific Outcome.

4.2 Infrastructure Code

Due to the significant amount of landscaping located along the site boundaries and the grass paving
proposed for the parking surface area, the proposal complies with the Overall Outcomes of the
Infrastructure Code. Relevant Specific Outcomes and Probable Solutions are identified below.

"FeOMPLIANCE’ "=

031 Sufficient separation distance is provided between
Infrastructure Uses and incompatible uses on the same
site and neighbouring premises to maintain amenity for
neighbouring uses.

The subject site is adjoined by a range of Community
Uses for which it is intended to service. Further, dense
landscape buffers are proposed along all boundaries to
ensure that the impact of vehicle noise and light
spillage is minimised. Accordingly it is considered that
the proposal is appropriately sited to ensure its
compatibility with surrounding uses.

$3.1 Vehicle access to the infrastructure is gained from
roads other than local residential streets to maintain
residential amenity.

The proposal seeks to gain access directly from David
Low Way. This access point ensures the amenity of the
surrounding residential streets is protected.

$6.1 Lighting associated with the use is designed,
installed, operated and maintained in accordance with
Section 3 of AS4282 The Control of the Obtrusive Effects
of Outdoor Lighting.

All light sources proposed for the carpark will comply
with Section 3 of AS4282 The Control of the Obtrusive
Effects of Outdoor Lighting.

Page 4

4.3 Landscaping Code

The mixture of mature tree planting, low dense shrubs and grass cell pavers ensure the proposed car
park meets the Overall Outcomes of the Landscaping Code. Relevant Specific Outcomes and Probable

Solutions are identified below.

THE NOOSA. PLAN:

“COMPLIANCE ©

a Rep BAD

$1.1 Requires a minimum of 15% of the site to be
landscaped, with the road front boundary to achieve an
average 2 metre width of planting.

These minimum requirements are both exceeded, with
almost 100% of the site surface treated with pervious
grass and plantings and a frontage characterised by
stepped car parking setbacks between zero and 6
metres containing a mixture of mature trees and dense
shrubs.

$1.2 Landscaping is designed, planted and maintained
in accordance with PSP3 Landscaping Plants and
Guidelines.

The Landscape Plan prepared by Place Planning Design
Environment and included as part of this submission
has been prepared in accordance with PSP3.

$2.3 Plants are grouped in mulched beds rather than
planted individually to provide for optimum growing
conditions and less maintenance.

Significant planter beds have been allowed for around
the perimeter of the site, as well throughout the car
parking bays. This allows for the clumping of planting.

$2.6 Alternatives to impervious pavement are provided
and are located where landscaping and existing
vegetation will benefit from increased infiltration of
rainwater.

The proposed pervious grass cell surface of the car
parking area as well as the significant garden irrigation
reservoirs demonstrates the proposal has been
designed with careful consideration to the utilisation of
rainwater run-off for landscaping areas.

04 Landscaping is designed and located to maximise
the safety and security of public and private areas.

The garden beds surrounding the perimeter of the site
contain a mixture of low shrubs and clean trunk mature
trees. This planting plan ensures that the pedestrian
pathways linking the parking area to the surrounding
Community Facilities maintain visual connectivity, thus
providing safety and security to their users. Further,
the setback of the mature planting from the proposed
driveway access point allows for adequate view lines
along David Low Way and the intersecting pedestrian
pathway.

28.1 One advanced canopy tree (a minimum of 100

litres pot size) is provided for every 6 car parking spaces.

Six 100L advanced canopy trees have been provided
throughout the proposed garden beds. These have
been positioned to ensure visual connectivity is
maintained between the parking area and neighbouring
community facilities, whilst providing shading for
parked cars.

wet

Page 5

$28.2 A minimum area of 5m2 is provided around each
canopy tree, which is mulched and treated.

As the canopy trees are all located with specifically
designated garden beds, adequate area is provided
around the base of these to allow for mulching and
treating.

$28.4 Semi-pervious pavement surfaces are used, such
as grass cell paving, to increase infiltration of rainwater
and minimise contaminated runoff, including
hydrocarbons, entering the stormwater system and
watercourses.

It is proposed to construct the car park surface from
grass cells, thereby increasing the infiltration of
rainwater and minimising contaminated run-off.

$28.6 Garden mounding is incorporated into car parking
areas adjacent to frontages.

Mounded gardens containing a mixture of canopy trees
and mounded shrub planting are established along all
property boundaries.

4.4 Engineering Works Codes

The plan included as part of this submission complies with the relevant requirements for car parking

areas as detailed in the Engineering Works Code.

5. CONCLUSION

It is proposed to establish a car park on the subject site. An assessment has been undertaken against
the code requirements identified in The Noosa Plan. As detailed above, the proposal complies with all
relevant Specific Outcomes and Probable Solutions and therefore Council’s support is recommended.

Advice for completing Part A

Page 9

INTEGRATED PLANNING ACT 1997 Part A, Version 3.1, 3 March 2008

General advice

. Part A of IDAS Development Application Form 1 must ke completed and accompany all development applications. The applicant is responsible
for answering all questions fully and correctly, unless following a response there is a statement to go directly to another question. The
Assessment Manger may refuse to receive an application that is not properly made.

° The IDAS Assessmeni Checklist must also be completed for all development applications, other than those requiring assessment against the
Building Act 1975 only, i.e. those applications requiring the completion of Parts A and B only.

Appticant details
° if the applicant is a company or organisation, a contact person must be nominated. The applicant's signature is not required to be provided
under the IPA.

Details of the premises

* The term ‘premises’ is defined by the IPA, schedule 10 to mean a building or other structure, and land (whether or not a building or other
structure is situated on the land). The term ‘land’ is also defined to include the estate in, on, over or under the land.

. Details of the land are not required if the application involves a mobile and temporary Environmentally Relevant Activity only. Instead complete
Table A.

° The premises may be identified in a number of ways ~

« Street address and lot on plan are most common and will apply to most applications.

» Coordinates may provide the best means of accurately identifying the location of development proposed in waters, or on a relatively small
development site distant from property boundaries on a large lot. Sufficient coordinates need to be provided to identify the boundary of the
premises the subject of the application. Eastings and northings using GDA94 datum is preferred, but longitude and latitude and other
(specified) datum such as Zone Reference or GS84 may be provided.

je The definition of ‘water body’ and ‘watercourse’ can vary from Act to Act.

* StrategicPortLandis within a local government area but a local govermment's planning scheme does not apply onStrategicPortLand.
StrategicPortLandis declared under the Transport Infrastructure Act 1994. For further information go to IDAS Guide 11 (Development on
strategic port land) and the Queensland Transport (Ports) website.

. “Tidal water’ is defined in the Coastal Protection and Management Act 1995 (Schedule) and ‘tidal area’ for a local government and for strategic
port land is defined in the IPA (schedule 10). Generally, the area below ‘high-water mark’ (defined by the Coastal Act in relation to high water
mark at spring tides) establishes the boundary of a tidal area, Land below high water mark is not within a local govermment's area unless
provided for under the Local Government Act 1993. Unless otherwise provided for by legislation, a local government has no jurisdiction below
high water mark. A tidal area for strategic port land is within the jurisdiction of the relevant port authority, white the Environmental Protection
Agency generally has jurisdiction for a local government tidal area. However, the IPA gives focal governments jurisdiction for assessing and
deciding applications for prescribed tidal works within the local government tidal area, and the planning scheme may be applied to that
assessment (to the extent provided for in the code for prescribed tidal work).

Resource entitlement

. Section 3.2.1(5) of the IPA requires evidence of resource entitlement be given for applications if they involve taking or interfering with a
prescribed State resource. Schedule 10 of the integrated Planning Regulation 1998 (IPR) prescribes the State resources, including State-
owned land, where evidence is required to be given, and the evidence required to support the application. Link to Integrated Planning
Regulation. Section 3.2.1(10)(a)(ii) states an application cannot be taken to be properly made without the required evidence.

° For applications involving the taking or interfering with water under the Water Act, the development application may be made at the same
time as the request for resource entitlement, and the Department of Natural Resources and Water will accept the application as properly made.

. For State-controlled roads, a resource entitlement is not required for an activity that is exempt ancillary works or encroachment (identified by
gazette notice under the Transport Infrastructure Act 1994, section 50), or if the activity requires referral to the Department of Main Roads.

. Evidence may be required from more than one Department responsible for a State-owned resource, e.g. from the Environmental Protection
Agency for quarry material below high water mark, and the Department of Natural Resources and Water in relation to the State-owned land
above high water mark.

Owner's consent

. Section 3.2.1(3) of the IPA prescribes that an application must contain, or be supported by, the written consent of the land owner/s, if the
application involves: a material change of use; reconfiguration of a lot; work on land below high-water mark and not within a canal as defined
under the Coastal Protection and Management Act 1995; or work on rail corridor land defined under the Transport Infrastructure Act 1994.

je Evidence of this consent may need to be provided before the application will be accepted as properly made by the Assessment Manager, during
the processes of the application or in the event of an appeal about the outcome of the application.

je “Owner for the purpose of a lodging an IDAS development application means the person at the time of lodging the application, entitled to
receive the rent for the land (or would be entitled to receive the rent for it if it were let to a tenant at a rent).

. Templates are available from the [PA website for the provision of owner's consent as an attachment to this form. However other documentation
may be used for providing owner's consent provided it is clear the documentation relates to the development application for the premises.

je Owner's consent, if required, must be provided even if the applicant is the owner. Owner's consent is not required for a mobile and temporary

ERA.

Portable Long Service Leave (PLSL) Levy

The Building and Construction Industry Portable Long Service Leave Scheme provides long service leave entitlements to workers in the building
and construction industry who would be unlikely to accrue enough service with one employer to qualify for long service leave. To fund the
scheme, a Portable Long Service Leave Levy (PLSL levy) is collected on certain building and construction work carried out inQueenstand.

The PLSL levy amount and other prescribed percentages and rates for calculating the levy are stated in the Building and Construction Industry
(Portable Long Service Leave} Regulation 2002. Included in the amount collected by QLeave is the Workplace Health and Safety Fee and the
Building and Construction IndustryTrainingLevy.

The Building and Construction industry (Portable Long Service Leave) Act 1991 (PLSL Act) defines the building and construction work subject to
the PLSL levy and includes renovating, relocating, constructing, altering, demolishing, maintaining or repairing buildings, pools, roads, jetties,
pipelines, fences or earthworks, and works for subdividing, irrigating or draining land.

The PLSL levy need not be paid when the application is made, but the PLSL Act requires the levy to be paid before a development permit may
be issued,

The Assessment Manager must sight an approved form issued by QLeave advising of the status of the payment of the PLSL levy. Building and
Construction Industry Notification and Payment Forms are available from anyQueenslandpost office or agency, on request from QLeave, or can
be completed on the QLeave website at www.gleave.qid.gov.au. For further information contact QLeave (Tel: 1800 803 481 Web:

1.0 INTRODUCTION

1.1 GENERAL

Milsearch Pty Ltd, a specialist company in the field of assessing and remediation of land previously
used for Military purposes was contracted by Alex Rigby (the Client) to conduct an Unexploded
Ordnance (UXO) search and remediation of Lot 95 on SP 137431, Peregian Beach, Sunshine
Coast. .

‘

1.2. SITE HISTORY

During the Second World War areas on the Sunshine Coast were established by the Australian
Military Forces as training areas to support war operations. This site lies within the area known as
the Coolum to Noosa Military Training Area and is in an area listed by Defence as having
“substantial” Unexploded Ordnance (UXO) contamination. The range was used for artillery, armour
and infantry live firing practice and exercises until the late 1950's. Over subsequent years there
have been numerous UXO items reported by the public within this area and, in more recent years,
additional UXO have been located by remedial searching.

This area was the subject of a report by Defence: Ops Br 0447/92 (Q1300-3-12) published April
1992. It was further updated by Defence in conjunction with the Qld EPA in early 1998

UXO SEARCH METHODOLOGY
SEARCH PROCEDURES

The following UXO search and remediation treatment was applied to the Site:

Search methodology was the conduct of a disciplined 100% analogue search at one (1)
metre lane intervals to a depth of one (1) metre. Principal search instrument was the
Foerster 4.032 Magnetometer. In magnetically hostile areas (for example: fence lines or
underground services such as sewerage and power cables) where the performance of the
Foerster 4.032 Magnetometer would be degraded, the Minelab F3 Metal Detector was used
to search these areas. This is a state of the art Australian designed electromagnetic
induction coil detector, built to military specifications. Technical specifications for the
Foerster 4.032 Magnetometer and the Minelab F3 Metal Detector are presented at
enclosure 1.

Principal target to be located was UXO equivalent to a 37mm projectile to its potential
kinetic depth, (approx 0.3 meters). This is the smallest item of explosive ordnance (EO)
known to be used in this area.

SITE TEST PIT
Prior to carrying out the UXO Search a test hole was excavated on site.

A 37mm projectile and a 6lb Artillery projectile were placed at depths of 30cm and 50cm
(respectively). The Foerster 4032 magnetometer was tested over these items at the specified
depths.

The tests were carried out at the start and end of the UXO Remediation with positive results. Both
items were easily detected at the specified depths.

4.3. CONDUCT OF SEARCH

Prior to a deep search, | conducted a site “walkover” to look for any more obvious pieces of metal
detritus. After testing the search equipment over the test holes and test pieces, a shallow search
was then conducted over the site using the F3. Particular attention was applied to the site
perimeter and around obvious items that would interfere with the magnetometer (obstacles on site
listed below) Numerous shallow targets were investigated and all proved to be domestic rubbish.

The Site, where possible, was then subjected to a disciplined and systematic 100% UXO search
along nominally one (1) metre wide transect lanes utilising a Foerster 4.032 magnetometer as the
primary search instrument (supported by the Minelab F3 metal detector). The search operations
were conducted in a north-south direction with alignment being maintained using marking tapes
and aluminium marker poles. All metallic contacts were excavated and investigated using hand
tools.

There was some interference along the Eastern boundary of the site due to the overhead power
lines running along David Low Way. The magnetometer was still able to be used in an alternative
search mode (mode 6). The southern boundary consisted of a large building including a basement
car park below ground level. The magnetometer was not able to be operated within 5 meters of this
building and a shallow search was carried out along this boundary using a Minelab F3 metal
detector. The western and northern boundaries had a permanent and temporary 2m (plus) metal
fence in place (respectively) and again a shallow search could only be carried out along these
boundaries.

There were three further obstacles within the search area namely:

(1) A site office for the neighbouring construction. This building measured 3m x 3m and was
situated at the Northern end of the site.

(2) A large sign advertising XXXX Gold for the Bowls Club.

(3) An underground sewer line running diagonally from the NW corner to the SE corner of the
site.

A limited shallow search only could be carried out in the vicinity of these obstacles

A total of 41 deep targets were investigated in those areas that were able to be searched by
Magnetometer (approx. 80% of the site). Of these all proved to be domestic metal detritus in the
form of reinforcing steel, bolts, nails, concrete, etc. A lot of the items found were most likely
imported with the gravel / road base material or left over from neighbouring construction. Unused
underground electrical wiring was also evident in one location at the southern entrance to the site.

No evidence of military activity was found at all.

5.0 QUALITY MANAGEMENT

5.1 QUALITY CONTROL

Milsearch Quality Control procedures are documented in the Milsearch Quality Management
document MilQM. This document mandates the Standard Operation Procedures (SOPs) that are
to be followed by all Milsearch EOD technicians in the course of UXO search and remediation. As
a minimum, QC ensured that all search equipment was inspected and tested at the beginning of
the daily work activities to ensure;

Page 29

¢ All equipment was tested and calibrated prior to the commencement of data gathering to
ensure it operated within the Original Manufacturers Specifications (OEM); and

e All equipment was tested during, and at the end of the day to ensure at all times, it
performed within the manufacturers specifications.

The following documentation, in support of Milsearch Pty Ltd QC procedures, is attached to this
Report;

¢ Search Equipment Daily Test Log is presented at appendix C.

5.2. QUALITY ASSURANCE

As part of the Milsearch Standard Operating procedures (SOPs), Quality was ensured by a formal
and documented QC program. These procedures ensure that a planned and systematic pattern of
all actions necessary to provide adequate confidence that management and technical planning and
controls have been adhered to ensuring;

© Ongoing supervision and QC checking revealed no faults in operator performance; and

e Asaminimum, the Project Manager carried out a 10% QC check of the entire Site. On this
particular site 3 lanes were searched in a north / south direction at an even spacing along
the site using the Foerster 4032, (approx 10 meters apart). As an added check a random
pattern was searched over the entire site using an F3 Minelab. There were nil significant
items found.

6.0 CONCLUSIONS

_ The Site, as identified by the Property Titie at Appendix E, has been subjected to a disciplined
100% UXO search and remediation. There were no significant finds and no items of Explosive
Ordnance Waste (EOW) were found. There were some areas within the site that were unable to be
searched however a significant part of the site was searched with no evidence of military activity
found.

It is obvious that there have been past works carried out on this site. There is a large underground
sewer (c/w 2 x manholes), that runs the length of the site. Also neighbouring construction would
have meant large earthworks have been carried out at the southern end of this site. The top level
of ground consists mainly of imported gravel and road base and the site has been used as a car
park for several years (plus). :

In view of the competence of the operator, the capabilities of the equipment, the results of regular
equipment testing and the outcomes of QC checks, it is considered that the methodology applied
to conduct the UXO search and remediation within this Site was appropriate and that a confidence
level approaching 100% has been achieved.

It is therefore the professional opinion of Milsearch Pty Ltd that to the best of our knowledge and
belief, within the limitations of the equipment, the Site is free of any remnant UXO.
