Dear Sir/Madam
Information Request
Planning Act 2016
I refer to your application and advise that Council requires further information to satisfactorily assess the proposal.
application details
Application No.	MCU22/0097
Street Address:	14-16 Reserve St Pomona Qld 4568
Real Property Description:	Lot 2 SP 115871
Planning Scheme:	Noosa Plan 2020 (25 September 2020)
INFORMATION REQUIRED
The information requested is set out below:
Issue – Plans
A full set of plans have not been provided in support of the development application.
Information Required
Provide a full set of elevations of the proposed building.
Issue – Access
The main entrance to the building is not visible and easily identifiable. There does not appear to provide a direct link from the car parking areas or from the roadside to the premises.
There is a gate to ‘Lease C’ from the car park and an access between the outdoor seating area and the adjoining distillery, although it is uncertain how customers navigate the site.
Information Required
Provide amended plans identifying the main entrance to the Food and Drink Outlet, and how customers are to navigate the site from the roadside and internal driveways/parking areas safely i.e. defined footpath.
How will the proposed restaurant and car parking area be separated i.e. landscaping, fence, footpath etc.
What is the future intent of ‘Lease C’, i.e., is this area intended to be used for overflow dining etc.
Clarify the relationship between the proposed development and adjoining distillery, and why the two uses have a shared access. What facilities (if any) do the two uses share.
Issue – Outdoor Dining
In considering the development involves open-air outdoor dining, to assist in assessment of potential impacts on sensitive receptors (alike residential uses), greater information is required.
Information Required
Detail separation distances between the development and nearby sensitive receptors.
Demonstrate how noise will be mitigated i.e. concentrated to one area, live music being staged away from boundaries etc.
Issue – Landscaping Plan
Details of landscaping and plant species have not been provided.
The Local Plan and Zone Code refer to soft landscaping and landscaping treatments being incorporated into the design of new developments to complement natural species occurring in the area and to reduce the visual impact of hard infrastructure/impervious areas.
Information Required
Provide a Landscaping Plan with species native to the area and identified in the PSP3 – Landscaping Policy. This may include, but not limited to:
The use of shrubs and garden beds between public spaces, walkways and the proposed area of development
To shade outdoor areas of seating.
Use of plants to conceal service and loading areas.
Screening along the perimeter of the development.
Issue – Stormwater Management
The proposed works will create a significant increase in hardstand within the site. It is unclear from the submitted documentation how the stormwater runoff generated by this hardstand will be collected and released from the site. Council note external hardstand from the existing neighbouring shed to the north is discharging to the existing carpark, increasing the catchment area beyond that of the existing carpark.
Note that the proposed works must not adversely affect the existing drainage conditions of the subject site and neighbouring properties.
Information Required
Provide a preliminary Stormwater Management Plan demonstrating how the stormwater generated by the hardstand of the proposed smokehouse and other impervious areas (landscaped, carpark) will be collected and released. The Stormwater Management Plan must be prepared by a suitably qualified person and include, but not be limited to:
a Lawful Point of Discharge; and
details (FSLs, invert levels, etc.) of the existing on-site stormwater system.
Issue – Vehicle Access
There is insufficient information for Council to assess the proposed access.
Information Required
Provide additional comment demonstrating how the proposed access will function. The additional comment should make reference to:
the type (foot, vehicle, etc.) and volume of traffic the access will serve; and
if both venues can function independently without the proposed access.
Issue – Carpark
It is unclear from the submitted documentation what sections of the existing crossover, drive and carpark are to remain, what works are being proposed, and how accessible the proposed gate will be while the proposed motorbike parks are occupied.
Council identified significant damage to the existing bitumen adjacent to Lot 2 in the existing drive and a bitumen property access along the northern side of the carpark serving Lot 1. The existing grade of this property access may result in rain water collected on the downward slope of the drive to enter Lot 1, creating pooling and potential flood risk if left unaddressed.
The carparking area and loading areas appears to be shared with the existing commercial uses on the site. The application material does not clearly describe how the various uses will share the carparking area.
Council is concerned regarding the capacity of the existing access driveway joining to Reserve Street to cater for the expected increase in traffic movement.
Information Required
Provide a Carpark Plan demonstrating the proposed works within the Carpark. The plan must be prepared by a suitably qualified person and include, but not be limited to:
existing sections are to remain;
proposed works;
spot levels and grades;
demonstrate a B99 vehicle (as described by AUSTROADS) can safely enter and exit Carpark 1; and
demonstrate that the proposed gate can function while both motorbike parks are occupied.
Provide a comment by a suitably qualified person regarding what repair works, if any, are to be conducted on the existing carpark, drive and crossover.
Provide a comment by a suitably qualified person regarding what design alterations will be made to the existing bitumen property access to Lot 1 to reduce the risk of pooling and flooding.
Please note that no new development can create a worsening of drainage conditions for neighbouring properties.
Provide additional comment on how the carparking area is to be shared with the existing commercial uses on the site, and how such uses will continue day-to-day operations with limited parking.
Provide an assessment of the existing access and its capacity to cater for the expected traffic movements. The assessment must be undertaken by a suitably qualified person and demonstrate that the access is safe for both vehicles and pedestrians at the entrance to the site.
Issue – Lease C
It is unclear from the submitted documentation what function ‘Lease C’ will serve to the proposed application. Council notes that any proposed changes to ‘Lease C’ may affect the drainage conditions of the carpark and neighbouring properties and must be taken into consideration.
Information Required
Provide an additional comment demonstrating how ‘Lease C’ will serve the proposed application.
Issue – Kitchen Layout
The attached kitchen fit out document may provide greater information as to what standard and extent of facilities are required for a food premises. It is recommended this is reviewed to ensure the development permit will not raise conflict with food licencing requirements at the point in time that licencing is sought.
Further information is required for food business fit out.
Information Required
Location of sinks, e.g. mop sink, hand wash basin, etc.
Information on how cooking/smoking fumes will be removed and distributed to the surrounding environment.
Issue – Waste Collection
Provide greater information in regard to what waste is being generated from the site (total site removal). Therefore, what sized bin services are required/frequency of bin services
Information Required
Identify total site removal, this will inform the appropriate bin sizes, storage area, frequency of servicing arrangement.
How the vehicle and enter and leave the site in a forward motion.
due date for response to information request
