The application is before Council due to the significance of the site and the requirement for an
Infrastructure Agreement to be entered into. The Infrastructure Agreement is required as Council
is upgrading the Hilton Terrace – Ernest Street intersection and these works necessitate the
acquisition of 135m² of land from the subject site. Furthermore, the Infrastructure Agreement is
required as the frontage works which are usually part of a development approval (kerb and
channeling, pedestrian footpath, crossovers etc) and additional works specific to this site and
application (on street car-parking bays on Hilton Terrace and relocation of Telstra services) are to
be undertaken by Council at the applicant’s expense.
