Noosa Council Submission 18 December 2015 - Final submission with table of submitters
Attached to the e-mail MCU15/0095 & REC15/0022 PM Submissions Object - Petition - Various.
Eumundi Noosa Road DA, the applicant successfully argued that the proposed retail
shop was a minor component of the development, as it was only approximately 4% of
the total GFA proposed. This is in stark contrast to the proposed development at 115
Eumundi Noosa Road, where the proposed retail shop is approximately 32% of the
total GFA.
10. It is also noted that given the proposed shop at 115 Eumundi Noosa Road will only be
approximately 200 metres from the service station shop at 139 Eumundi Noosa Road
and that they are both located on the same side of the road, the two service station
shops will be in direct competition with each other. As such, the proposed shop will
negatively impact on the service station shop at 139 Eumundi-Noosa Road which has
already been approved in June this year.
11. In light of the above, the applicant has not established that there are sufficient
grounds for the Noosa Council to approve the DA, despite the inconsistent use.
Further, we contend, that there are no grounds on which the Noosa Council is justified
in approving the DA, notwithstanding the conflict.
12. Further, it is not appropriate for Noosa Council to approve a proposal which is directly
and significantly in conflict with a formally expressed planning strategy. This is
supported by the following two planning grounds under the Noosa Plan which directly
relate to retail uses and land zoned Industry:
DESIRED ENVIRONMENTAL OUTCOMES
13. Part 3 of the Noosa Plan contains the Desired Environmental Outcomes (DEO).
Relevant to this issue, the DEO for Commercial & Retail Uses states at section 3.1.3:
b) Commercial & Retail Uses
“A hierarchy of centres with a range of Commercial and Retail business uses provide
suitable levels of amenity, service and access to the community, consistent with the
community’s location and needs and is based on—
viii. Uses that comprise a large component of Commercial and Retail business uses or
other non-industrial uses are not located on land that is otherwise intended for
Industrial business uses;…”
14. Given that more than one third of the GFA of the proposed development is taken up
by the proposed service station shop, it is considered that the DA comprises a large
component of Commercial and Retail business uses and, as such, should not be
located on Industry zoned land. Non-compliance with this DEO demonstrates that the
DA does not meet one of the key aims of the Noosa Plan, which is consistent with
community expectation regarding retail intrusion into the industry zone.
