NOOSA PLAN 2020 PROPOSED AMENDMENT NO. 2 - POST PUBLIC NOTIFICATION FOR FINAL STATE GOVERNMENT MINISTERIAL APPROVAL · Report
Plans and drawings: the text below has words only, no drawings.
SPECIAL MEETING 5 DECEMBER 2024
1. Noosa Junction Hospitality Precinct - hours of operation extension and music
The advertised amendment proposed to:
• extend the operating hours for food and drink outlets from 10pm Sunday - Thursday and
midnight Friday - Saturday to midnight 7 days a week; and
• introduce a new definition for amplified music to enable application of the same provisions
as live music to all amplified music.
Submissions
Submissions on the proposed extended hours of operation and music definition varied with both
support and objection to the proposed amendments. Some submissions supported the extension of
operating hours citing increased viability for new food and drink outlets allowing later seating of
patrons. These submissions were from business owners and Noosa Junction Association
representing a number of landowners and businesses in Noosa Junction.
Most of the submissions relating to the Noosa Junction Hospitality precinct came from residents who
did not support the extended hours with concerns about existing and potential extended noise
impacts later into the evening from Sunday to Thursday. Issues around amplified music was raised
with some confusion the proposed amendments were extending music operation hours, which they
are not.
Three submissions requested the inclusion of 36 Sunshine Beach Road to the Hospitality Precinct.
Response
The purpose of the proposed amendments is to enable existing and future food and drink outlets to
have operating hours consistent with existing businesses with existing use rights and to extend the
service offering. To balance this with potential noise impacts, it is proposed to amend the amplified
music provisions to apply to both indoor and outdoor spaces and restrict amplified music after 9pm
from Sunday to Thursday, unless the venue is acoustically treated to a suitable level.
The proposed amendments introduce a definition for amplified music to ensure that both recorded
and live amplified music are both addressed.
It is important to note that compliance for noise issues associated with a Liquor licences are
undertaken by the Office of Liquor and Gaming Regulation (OLGR) and not council. OLGR are
currently actively undertaking compliance around noise from food and drink outlets and other
entertainment venues, particularly from amplified music in Noosa Junction, separate to the proposed
amendment process.
Noosa Plan 2020 currently requires the acoustic treatment of dwellings in mixed use buildings in
Centres. To ensure new dwellings immediately adjoining a Major Centre Zone are also acoustically
treated, this requirement should be extended.
Any change to the extent to the Hospitality Precinct would be considered a significant change and
require further public notification, and therefore cannot be considered as part of this amendment
process.
Recommendation
It is recommended the following changes be made to the proposed amendments as advertised in
response to submissions:
• proceed with the proposed extended hours of operation for food and drink outlets to 12
midnight seven days per week;
• include a provision that no amplified music is located on site (indoor or outdoor) beyond 9pm
from Sunday - Thursday unless the site has been acoustically treated to the appropriate
levels;
