EXECUTIVE SUMMARY
Not applicable.
RECOMMENDATION
That Council note the report by the Community Facilities Manager to the Services & Organisation
Committee Meeting dated 12 October 2021 and:
A. Authorise the Chief Executive Officer to extinguish the current Noosa FM lease at The J; and
B. Authorise the Chief Executive Officer to enter into negotiations with Noosa FM for a new 3-
year lease at The J with an option of two further 3-year lease terms (in accordance with the
Community Purpose Land and Infrastructure Tenure Policy) at Council’s sole discretion; and
C. Apply the exception to the requirement for tendering of the lease under Section 236 (1) (b) (ii)
of the Local Government Regulation 2012, as the lease is to a community organisation.
REPORT
Background
Noosa FM were a founding tenant at The J from the time of its opening in 2006. The original lease,
voluntarily signed by both parties, outlines the following key terms:
An initial 5-year term from 1 October 2006 to 30 September 2011, with 3 x 5-year options
thereafter;
Base rent of $6,000 p.a. from 1 October 2006 to 30 September 2009;
Base rent of $10,000 p.a. from 1 October 2009 to 30 September 2011;
Base rent of 50% of the current market rent from 1 October 2011 to 30 September 2016; and
Base rent of 66% of the current market rent from 1 October 2016 to 30 September 2026.
Base rent is defined as being the cash component payable by Noosa FM and is supplemented by a
community contribution component. The community contribution component comprises a range of
community advertising, simulcasting and training requirements and when combined with base rent,
forms total rent.
When The J looked to increase Noosa FM’s rental payments to $10,000 in 2009, Noosa FM
requested for the rent to remain at $6,000 p.a. (plus CPI increases) on the grounds of being unable
to afford a rental increase. Noosa FM were successful with their request, however, there was no
clarity regarding an expiration date of this variation and thus the reduced rental rate remained in
place through to the end of calendar year 2017.
In 2017, Noosa FM belatedly requested the activation of the next available lease extension option.
At the time, Noosa FM was unable to comply with the full financial requirements stipulated by the
lease (i.e. the suggested rental rate) and as such the extension option was not activated by Council.
Section 5
SERVICES & ORGANISATION COMMITTEE MEETING AGENDA 12 OCTOBER 2021
The lease stated that by this point, unless otherwise negotiated, the base rent should be 66% of
market rate, which was assessed as being $52,000. As such, Noosa FM’s base rent charge should
have been $34,320.
Management held a number of discussions with Noosa FM’s committee regarding the matter but
was unable to reach an immediate resolution. In late 2017, Noosa FM’s committee of the day agreed
to increase rental payments to $18,000 for 2018 only, with the view to negotiating arrangements
beyond this.
Subsequent to that agreement, the committee changed and the new committee communicated their
belief to Council that enforcement of the original lease terms would place significant financial strain
on the organisation and could result in its eventual collapse.
After further consideration, in December 2018 the Community Facilities Manager proposed to
Council that the current Noosa FM lease be extinguished and replaced with a shorter-term lease at
a reduced rental rate. At the time of that report, the latest option had not been activated by either
party and under clause 32 of the lease, it was essentially being held over under agreed terms and
conditions.
At its Ordinary Meeting on 20 December 2018, Council resolved:
That Council note the report by the Community Facilities Manager to the Services & Organisation
Committee Meeting dated 11 December 2018 and agree to:
A. Extinguish the current Noosa FM lease at The J and replace it with a new 2 year lease (based
on Council’s standard lease terms and conditions) with the option of further three x 1-year
terms at Council’s discretion and an annual rental of $6,000 pa (plus CPI increases);
B. Apply the exception to the requirement for the tendering of the lease under Section 236 (1) (b)
(ii) of the Local Government Regulation 2012, as the lease is to a community organisation;
C. Consider any financial implications of this new lease arrangement in BR3, and
D. Reconsider Council’s position of providing both a rental subsidy and a Community Alliance
grant to Noosa FM, when Noosa FM’s 3-year Community Alliance funding comes up for
renewal in the 2019/20 community grants round.
In the time since the report was delivered to Council, the rental rate charged to Noosa FM was
reduced to align with the Council-adopted rate ($6,000pa + CPI), however, the new lease was never
formalised due to ongoing concerns about Noosa FM’s stability and long-term financial viability.
However, financial and operating updates provided to Council over the past couple of years show
that Noosa FM’s position has now stabilised and its viability appears sound. Noosa FM have
approached management about formalising a new lease in order to provide some longer-term surety
for the station. Management believe this is now a reasonable request and as such recommend that
this happens.
Officer’s recommendation
As Noosa FM have demonstrated financial and operational viability over the past two and a half
years, management recommends that Council extinguish the current lease (which is technically in
holdover despite non-compliance with the terms from Noosa FM over the past several years) and
replace it with a new 3-year lease with the option of a further two 3-year terms at Council’s sole
discretion. When considering the activation of future options, management will continue to take into
account the station’s operational and financial stability and viability, as well as assessing whether
the station’s services to the local community continue to be deemed to be delivering sufficient value.
It is recommended that the rental amount commence at its current rate of $6,175.22 p.a., with CPI
increases to apply thereafter for the first lease term in accordance with Council’s standard leasing
arrangements. Beyond the first rental term it is recommended that a rental review clause allow for
Council to review and potentially increase rent beyond CPI if Noosa FM’s capacity to pay materially
increases beyond current levels. This is suggested as a way to potentially realign the nature of the
Page 5 of 44

SERVICES & ORGANISATION COMMITTEE MEETING AGENDA 12 OCTOBER 2021
lease with what was originally envisaged and agreed to upon (i.e. semi-commercial) at inception,
when the commercial viability and performance of community radio stations was generally much
stronger than it is today. To be clear, Council would only consider such a review should Noosa FM’s
operational performance increase markedly.
If adopted, this recommendation will provide Noosa FM with long-term rental security and allow them
to confidently plan for a future at The J, with a potential maximum lease expiry of 2030 (four years
beyond the maximum tenure of the original lease). It also provides both parties with some flexibility
should Noosa FM’s operational position change.
It should be noted that the proposed tenure fits within the maximum permissible term (10 years)
under Council’s Community Purpose Land and Infrastructure Tenure Policy.
Previous Council Consideration
Ordinary Meeting Minutes, 20 December 2018, Item 5, Page 16.
That Council note the report by the Community Facilities Manager to the Services & Organisation
Committee Meeting dated 11 December 2018 and agree to:
A. Extinguish the current Noosa FM lease at The J and replace it with a new 2 year lease (based
on Council’s standard lease terms and conditions) with the option of further three x 1-year
terms at Council’s discretion and an annual rental of $6,000 pa (plus CPI increases);
B. Apply the exception to the requirement for the tendering of the lease under Section 236 (1) (b)
(ii) of the Local Government Regulation 2012, as the lease is to a community organisation;
Finance
It is prudent to note that in real terms, Council has typically provided a rental subsidy of approximately
$46,000 p.a. to Noosa FM ($52,000 commercial value of the site less the roughly $6,000 annual
payments received most years through to 2021). In addition, Council also currently provides
approximately $8,000 p.a. to Noosa FM via a Community Alliance grant. The resultant outcome
under this scenario is that Council provides total cash and in-kind support to Noosa FM to the value
of approximately $54,000 p.a.
This is a significant level of financial support and is a matter that should be fully understood prior to
Council endorsement of this report’s recommendation.
The financial outcomes of the recommendation are already factored into current and forecast
operational budgets and will therefore not have any impact on the team’s future performance against
budget.
Risks & Opportunities
From Council’s perspective, not having a viable lease in place with Noosa FM presents a heightened
level of operational risk in comparison to having such an agreement in place. In addition, continued
uncertainty around Noosa FM’s tenure at The J makes it somewhat difficult to plan for the future and
regular and recurring discussions on this matter distract management from the achievement of other
priorities at the venue.
Security of tenure is often a requirement of government agencies’ grant programs which community
organisations such as Noosa FM regularly seek to access. Noosa FM may potentially be overlooked
for such funding opportunities for projects and programs which improve facilities and build
community capacity if secure tenure arrangements are not in place.
Section 7
SERVICES & ORGANISATION COMMITTEE MEETING AGENDA 12 OCTOBER 2021
Gaining agreement to establish a longer-term lease that both parties can operate in accordance with
should alleviate the issues outlined above.
One opportunity that has been considered by both Council and Noosa FM is that of an alternative
location for Noosa FM. From the station’s perspective this was considered as a way of potentially
reducing the annual rental charge and strengthening the station’s financial position. From Council’s
perspective it was a chance to consider other possible building utilisation options. Ultimately,
however, both parties have determined that the best location for Noosa FM for the foreseeable future
is at The J.

SERVICES & ORGANISATION COMMITTEE MEETING REPORT 12 OCTOBER 2021
4 COUNCIL MEETING SCHEDULE 2022
Author Chief Executive Officer, Brett de Chastel
CEO’s Office
Index ECM/ Subject/ Council Meetings General
Attachments 1. Council Meeting Schedule 2022
EXECUTIVE SUMMARY
Not applicable.
RECOMMENDATION
That Council note the report by the Chief Executive Officer to the Services & Organisation
Committee Meeting dated 12 October 2021 and approve the Council meeting dates for 2022 as
set out in Attachment 1 to the report.
EXECUTIVE SUMMARY
The Council adopts its meeting timetable on an annual basis. This enables the community to be
aware of when Council meetings are scheduled and for staff to develop timetables for preparing
agendas for those meetings. This report puts forward for adoption the proposed timetable for 2022.
REPORT
At the Ordinary Meeting on 30 April 2020, Council adopted its Council meeting structure
incorporating three Standing Committees and an Ordinary meeting.
In consultation with the Mayor and Councillors, no changes have been proposed to these existing
arrangements at this stage, however it would be appropriate for the Council to review the
chairperson/membership of the committees in April 2022 which marks the halfway point of this
Council term.
A draft Council Meeting Schedule for 2022 has been prepared for Council’s consideration (refer to
Attachment 1).
As per previous years, the first meeting round of the year (January) will only consist of a General
Committee Meeting (17 January) and an Ordinary Meeting (20 January). There won’t be a
Planning & Environment Committee or Services & Organisation Committee meeting held in
January. This is due to the timing of report deadlines conflicting with the Christmas/New Year
period and the availability of staff over this time. The agenda for the January meeting is normally
quite a small one in any event.
The only other timing difficulty is in April with Easter resulting in the General Committee being held
on a Tuesday instead of the Monday. April is always a difficult month with timing due to public
holidays.
Also, as recently discussed with Councillors, some administrative changes are being put in place
to assist with streamlining the process of Council meetings. This includes:-
all reports to Council having Executive Summaries – these are being phased in this and the
following round of meetings;
staff providing a verbal introduction to their report at the Council committee meetings to help
frame the key issues for consideration; and
endeavouring to reduce the number of reports going directly to General Committee (without
going through the Planning and Environment and Services and Organisation Committees) to
provide Councillors with more time to consider those reports.

SERVICES & ORGANISATION COMMITTEE MEETING REPORT 12 OCTOBER 2021
Community Based Council Meetings
Pre-covid, Council traditionally held two Ordinary Council meetings per year at different locations
within Noosa Shire as an opportunity to meet local residents to discuss local issues and enable
local residents to watch a Council meeting. They have been very well received by those attending
those meetings. Over the last few years, Council meetings have been held at Kin Kin, Cooran,
Pomona, Cooroy, Boreen Point, Federal, Peregian Beach, Sunshine Beach and Noosa Junction.
It has not been practical to undertake these meetings during the Covid period. It is suggested that
the Council can revisit the opportunity to hold such meetings again in March 2022 when there may
be more clarity about undertaking such meetings on a (hopefully) post Covid environment.

Finance
Provision exists within the 2021-22 budget to meet any expenses associated with the conduct of
Council meetings.
Risks & Opportunities
Section 277 of the Local Government Regulation 2012 (the Regulation) requires Council to publish,
at least once per year, a notice of the days and times of its Ordinary meetings and Standing
Committee meetings. Section 257 of the Regulation requires local governments to meet at least
once per month. There is a risk that Council would be in breach of the Regulation if it elected to
alter the frequency of meetings to less than once per month, and/or if it elected not to adopt and
publish an annual meeting schedule.

5 NOOSA SHIRE COUNCIL SOLE AND SPECIALISED SUPPLIER LISTS
Author Procurement and Contracts Advisor, Leigh Mooney

Index ECM/ Subject/ Purchasing and Supply Matters
Attachments 1. Sole Supplier List
2. Specialised Supplier List
EXECUTIVE SUMMARY
The procurement of all Council’s goods and services must be carried out in compliance with the
Local Government Act 2009 (‘the Act’) and the Local Government Regulation 2012 (‘the
Regulation’). The Regulation provides for the procurement of medium-sized and large-sized
contracts, and also allows for exceptions to these requirements under certain circumstances such
as the approval of a supplier being deemed a sole or specialised provider.
RECOMMENDATION
That Council note the report by the Procurement & Contracts Advisor to the Services &
Organisation Committee Meeting dated 12 October 2021 and
A. Adopt the Sole Supplier list provided at Attachment 1 to the report for the next twelve (12)
months; and
B. Adopt the Specialised Supplier list provided at 2 to the report for the next twelve (12) months.
REPORT
The Regulation provides for different methodologies to establish medium and large sized contracts.
Medium sized contracts, defined as being of contract value greater than $15,000 and less than
$200,000 (exclusive of GST), require three (3) written quotations to be invited.
Large sized contracts defined as being of contract value greater than $200,000 (exclusive of GST);
require written tenders by public invitation.
The Regulation (Section 235) allows exceptions to these requirements under certain
circumstances, including where the suppliers are sole or specialised providers of a good or service:
A local government may enter into a medium-sized contractual arrangement or large-sized
contractual arrangement without first inviting written quotes or tenders if—
(a) the local government resolves it is satisfied that there is only 1 supplier who is reasonably
available; or
(b) the local government resolves that, because of the specialised or confidential nature of the
services that are sought, it would be impractical or disadvantageous for the local government
to invite quotes or tenders.
As such, Council reviews the sole and specialised lists annually to ensure their appropriateness
and currency and subsequently seeks Council resolution to adopt the revised/amended lists.
A resolution to adopt these updated lists will allow Council to engage with these sole and
specialised suppliers in a more timely manner than if inviting quotes or tenders.
In this regard, Council is to note the following:
Sole Supplier List – No change from the previously adopted list (refer Attachment 1).
Specialist Supplier List – Additions have been noted in blue text (refer Attachment 2).

Ordinary Meeting Minutes, 15 October 2020, Item 8, Page 6
That Council note the report by the Procurement and Contracts Advisor to the Services &
Organisation Committee Meeting dated 6 October 2020 and the further report to the Ordinary
Meeting dated 15 October 2020 and:
A. Adopt the Sole Supplier List provided as Attachment 1 to the Services & Organisation
Committee Meeting report; and
B. Adopt the Specialised Supplier List provided as Attachment 2 to the Services & Organisation
Committee Meeting report incorporating the following amendments:

Risks & Opportunities
There is risk associated with not having these lists available to Council for the engagement of
sole/specialised services in a timely manner. Additionally, the ongoing availability of these lists by
resolution, amended/updated annually, reduces Council’s risk of breaching regulations relating to
the establishment of medium and large sized contracts.

Budget Commentary
For financial year 2020-21, Waste Management delivered an operating surplus of $3.6M which was
$167k unfavourable to budget. This compromises a general business operation surplus that
outperformed budget by $840k but offset by an additional $1M in finance costs due to a review of
the landfill rehabilitation provision.
Revenues were above budget $531k mainly due to higher:
Landfill fees of $296k due to higher volumes;
Sale of recyclables above budget $182k; and
Infringements above budget $31k.
Controllable expenses were below budget $310k mainly due to:
Waste collection costs below budget $147k;
Maintenance costs below budget $62k;
Bin purchases below budget $74k;
Employee costs below budget $64k due to vacancies; and
Hazardous waste disposal costs below budget by $31k.

2. CAPITAL WORKS
Over the last 6 months, Council’s consulting design engineers have been working progressively on
the masterplan for the landfill. Key projects have included:
- The redesign of cell 1.1 and 2.2 expansion. It was identified there was additional land available
at the southern end of the landfill that was not being utilised in the current design; the redesign
of the cell expansion has resulted in an additional two years of life to the landfill.
- Approval of design for the new clean water drain at the southern end of the landfill, including
a second sedimentation basin to facilitate site stormwater management.
- Final design stages of cell 1.1 capping to meet environmental compliance obligations. This is
required to reduce the potential contamination of groundwater and surrounding waterways, as
well as reduce the production of leachate to be managed onsite. It also ensures maximum
efficiency of methane capture to reduce emissions in alignment with Council’s ZEN target.
- Design of cells 2.3 and 2.4 in preparation for waste disposal when current cells are full.
Additional works have been undertaken to provide supporting information for future capital works
programs, including:
- Flood modelling and early investigation works for the potential resource recovery area (RRA)
expansion in preparation for conceptual design. The expansion of the RRA is required for
safety reasons, as well as to maximise Noosa Shire’s potential in recycling and resource
recovery.
- Site-wide soil mapping to provide an understanding of the material bank available for upcoming
capital works projects.
The upgrade and installation of the new outbound weighbridge and gatehouse has temporarily been
put on hold until design for the RRA expansion has reached conceptual approval. In addition, a new
waste disposal area is still awaiting final design for construction in the Noosa Woods to facilitate the
servicing of Hastings Street and reduce impacts on residents and visitors to the area.

The table above illustrates the recent increase in the number of customers using the sites over the
reporting period. Transactions have been steadily increasing annually, however, the last financial
year saw a significant upward trend. It is likely that this is due to additional domestic users during
the recent Covid-affected period.

SERVICES & ORGANISATION COMMITTEE MEETING REPORT 12 OCTOBER 2021
The above chart illustrates the amount of waste received at the facility and the amount that goes to
landfill. The chart above does not reveal any notable trends. The period was dominated by the Covid
pandemic and therefore comparison against data from previous years would show an increase that
has come as a result of an atypical demand driver.
Trends in waste prior to Covid show that Noosa Council is consistently recycling more waste material
each year. Amounts of waste entering the facility are also consistently increasing. Council’s Waste
team have commenced compiling and analysing all available waste data on a weekly basis. This is
to better understand trends and how new Council initiatives can influence the diversion and recycling
of waste material. The revised data collection, analysis and presentation will form part of the next
six-monthly report.

4. WASTE EDUCATION
The waste education program was significantly impacted by Covid-19, however, staff continued to
deliver waste reduction and recycling programs through available mediums.
Schools program
Recycling and waste education talks and workshops have been delivered to six different schools
and kindies and two community groups in the Noosa Shire from Jan – Jun 2021. More than 636
people have experienced these sessions.
Media, social media and promotion
Weekly ‘Waste-Free Friday’ Facebook posts have been used to engage with the community
during the six-month period, with over 28 Facebook posts published. This included
‘International Composting Week’, Waste-Free Fridays and Climate Week. These posts gave
ideas and guidance on how to reduce waste and reached over 130,253 people.
Noosa Council bin covers were used at a range of events, e.g., Noosa Alive, Noosa Laneway
Festival, Festival of Water etc. The bin covers are used to promote effective recycling.
Council officers assisted several resorts in ways to reduce waste and reduce contamination by
supplying signage.
Activities planned for Jul – Dec 2021
Plastic Free July.
Talks and landfill visits with schools and community groups.
Waste webpage redesign and development of new videos.
Roll out and promote the Aspire program.
Develop new promotional material to be used for events.
Preparation for National Recycling Week in November - organise workshops, movies and talks.
Six-monthly waste audits – domestic and commercial. Leading into a strategy to improve waste
management behaviour.
Example of Waste-Free Friday social media campaign.

5. ENVIRONMENTAL
Methane collection has increased by approximately 50% with the addition of the ring main and 13
veritcal gas wells installed in February 2021 – refer to figure 1 below. The additional wells have also
increased the capture potential for emissions of carbon dioxide as shown in figure 2.

FUTURE PLANNING
Strategy
The Waste branch is in the process of drafting a long-term strategy for waste management in Noosa.
Over the next six to twelve months the following work will be completed:
An options report on the future delivery of bulk waste ‘kerbside’ collection will be provided for
Council consideration.
The community and key stakeholders will be engaged and consulted during the production of
a draft strategy to manage waste in Noosa over the next 10-20 years. The strategy will
consider:
o The circular economy and optimising waste reduction and recycling.
o Meeting Council’s ZEN targets.
o Future collection service options.
o The use of new technology for waste treatment and disposal.
o Optimising the Eumundi Road facility to become a regional resource recovery hub.
o Waste education and behaviour change within the community.
Workshops will be conducted with Councillors and key staff on the waste strategy and the
outcomes of the community engagement.
The finalised strategy will be presented to Council for consideration and endorsement.

Risks & Opportunities
The Waste sector is currently facing significant challenges and the need for change, brought about
by:
Escalating state government landfill levy costs and levy charges which are expected to include
residential (MSW) waste from next year. This comes with the potential to increase the incident
rate of illegal dumping and the possibility of disparities of levies between regions.
Bans on exporting waste overseas.
Increased focus on waste management from the public.
State and federal government waste reduction and recycling targets.
Emission reduction targets set locally and internationally.
Reduction in available landfill space.
