There is no Probable Solutions provided for the Specific Outcome 187 of the Noosaville Locality Code –
Specific Outcomes and Probable Solutions for the Industry Zone. The proposal contains a shop that is
associated with the service station and food outlet which does not strictly adhere to the Specific Outcome of
O187 which states:
        O187 The following defined uses and use classes are inconsistent uses and are not located in the
        Industry Zone—
        a) All Agricultural Uses;
        b) Commercial business;
        c) Entertainment and dining business;
        d) Home-based business;
        e) Industrial business Type 3
        f) Retail business Types 1, 2 or 7;
        g) Retail business Type 4 if not a vehicle sales premises located with frontage to Lionel Donovan
        Drive
        h) Education if not Type 3 and trade related vocational training;
        i) Emergency Service Type 1;
        j) Open Space;
        k) Wellbeing;
        l) Transport Type 4;
        m) Detached house;
        n) Community residence;
        o) Multiple housing; and
        p) Visitor accommodation
The proposal is for a service station that consists of an associated shop (defined as Retail Business Type 2)
and a food outlet (defined as Entertainment and Dining Business) which are considered as inconsistent
uses. However, it is noted that the modern-day service station incorporates a convenience component to the
development which often takes the form of a small store and/or food outlet. The objective of the proposal is
to not only provide a fuel service to the community but also a convenience service as well. For the proposal,
in particular, it has incorporated an ancillary shop to the service station and a food outlet. The inclusion of
additional uses allows the development to service the surrounding businesses. The proposal also
encourages employees of the area to walk to the shop/food outlet to purchase food for meals or other small
items.
It is also noted that there is an existing fast food café on site that provides services for employees in the
area. This also demonstrates that a food outlet is already servicing the surrounding areas and has
overcome the conflicts of the development scheme as it is operating successfully on site.
Furthermore, a previous approval was made for a similar development and should be recognised as it was
approved within the industry zone. MCU14/0102 was approved and included the uses Entertainment and
Dining Business Type 1 Food and Beverage and the Retail Business – Type 2 Shop and Salon. These uses
were approved in this application despite the uses being inconsistent with the zone.
The proposed shop and café which is a typical ancillary component of a modern service station will be
provide at a small scale and is appropriate and compatible with the main consistent use of a service station
