PLANNING & ORGANISATION COMMITTEE MEETING AGENDA 28 JANUARY 2014

 amend the adopted charge rates applying to residential 2 bedroom dwellings from
$19,500 to $20,000 and 3 bedroom dwellings from $27,000 to $28,000 being the
maximum permissible under the “State Planning Regulatory Provision (adopted
charges) (SPRP)”. This will remove the current apportionment adjustments that occur
due to Unitywater’s portion based on the maximum charge and Council’s portion
          being reduced to make up for the current lower adopted charge;
 amend the charge rates applying to short term accommodation and special use
development classes to align with the current “Statutory Planning Regulatory
Provision (adopted charges)”. Notably the “Statutory Planning Regulatory Provision”
changed after the Sunshine Coast Council adopted the infrastructure charges
resolution in relation to these use classes. This will cease inconsistencies occurring in
applying charges to these development use classes and require only one calculation
          method to apply;
 apply discounts for existing development on a specific network basis and not to be
transferable between networks. This will cease cross subsidising of credits between
networks and in particular between Council and Unitywater networks. For example if
a credit for the existing development applying to the sewerage component exceeds
the sewerage component charge for the new development, the balance should not
translate across to reduce any other network component charge such as a reduction
          to the transport network; and
 clarify that development, that is the provision of “trunk” infrastructure, is exempt from
and not subject to infrastructure charges. For example if a development constructs a
portion of “trunk” pathway, the charge applicable to the development should not
include a charge for stormwater relating to the impervious area of the “trunk”
          pathway.

The current charge of $13,000 for a 1 bedroom dwelling unit is below the permitted
maximum of $20,000. However amendment is not proposed since it is considered
inequitable to apply the same maximum charge that applies to a larger 2 bedroom dwelling
unit that places a heavier demand on infrastructure networks.

No changes are proposed to the current reductions applying to:

 Sport and recreation uses currently being exempt from the “Public Parks and Land for
Community Land” proportion of the adopted charge. For example, an indoor bowls
centre provides additional and alternative sport and recreation opportunities to that
provided by the Council network and therefore could be considered as already
          contributing in this regard.
 Retirement and residential care development uses currently have a reduction to 70%
of the net charge for the Transport and Parks networks. This is in recognition that
such developments generally place lower demands on these networks and also
maintains the former Noosa Planning Scheme Policy demand allocations in
          determining contributions.

Internal consultation on this issue has been undertaken with the Coordinator Development
     Assessment.

2. Application of infrastructure charges relating to missing networks for “Extension to
Relevant Period” to existing development approvals and for charges applicable to
     subsequent “Building Approvals”.

Section 388 of the “Sustainable Planning Act 2009”, provides that Council, in deciding a
request to extend the relevant period, must have regard to the consistency of the approval,
including its conditions, with current laws and policies applying to the development,
including for example the amount and type of infrastructure contributions or charges.
