The table identifies that the proposal is more compliant with the Business Centre Zone than the
Attached Housing Zone. Whilst this is generally accepted due to the nature of the development,
the absence of compliant roof form and eaves is reflective of the concerns previously raised
regarding the built form character.
Land Use & Works Provisions
The following codes which regulate land use and design are most applicable to this application:
Business Uses Code
Residential Uses Code
Landscaping Code
Engineering Works Codes
Reconfiguring a Lot Code
Pertinent issues arising from assessment of the development against the above codes are
detailed below:
Car parking
The following table details an assessment of car parking for the development.
Use Car Car parking Proposed to be Complies
Parking Provided
Required
Retail Business - Type 2 Shop & Salon 34 23 car spaces on site
1 per 20m2 of gross floor area (gfa) 5 car spaces and 8 scooter
678m2 gfa proposed spaces in road reserve
Total 34 30 No
The applicant has proposed to construct 5 new car spaces and 8 scooter spaces in the Opal
Street road reserve. If accepted this would result in the total number of car spaces being 30 and
resulting in a deficiency of 4 car spaces. However, given the proposed works within the road
reserve will impact on the existing street trees it is recommended that on-street car parking be
limited to 4 car spaces and 4 scooter spaces.
