PLANNING & ENVIRONMENT COMMITTEE MEETING AGENDA 11 JUNE 2019
3.4. Draft Noosa Plan
The draft Noosa Plan seeks to zone the site to District Centre and the proposed retail premises
are a consistent use within this zone and would change the level of assessment from impact to
code.
4. CONSULTATION
4.1. Referral Agencies
The application was referred to the following Referral Agencies:
Department of Infrastructure, Local Government and Planning (SARA)
The Department is a referral agency for State transport corridors and future state transport
corridors.
The Department has responded advising that it does not object to the application subject to
compliance with conditions which require:
the re-location of the existing bus stop and associated infrastructure;
the removal of existing vehicle property access between Lot 5 and Cooroy Connection Road
and reinstatement with kerb and channelling; and
stormwater management of the development not worsening or causing actionable nuisance
to the state-controlled road.
4.2. Other Referrals
The application was forwarded to the following internal Council officers:
Coordinator, Development Engineering
Environment Officer - Landscaping
4.3. Public Notification
The application was publicly notified for 15 business days in accordance with the Planning Act
2016. No properly made submissions were received.
5. CONCLUSION & REASONS FOR DECISION
The application is for use of 34 Elm Street for Retail Business - Type 2 Shop & Salon. The retail
business use is identified within The Noosa Plan as an inconsistent use for the site. Whilst the
commercial/retail use is inconsistent with the Noosa Plan it is consistent with the prevailing
pattern of zoning and land use for properties within proximity of the site that front Elm Street.
The subject site is a prominent site and the proposed development will have a significant impact
on the streetscape. The applicant provided amended plans in response to concerns raised
regarding streetscape character. Whilst these plans deleted a second crossover to Opal Street
further changes are required to address a shortfall in car parking, improvements to the northern
elevation and achieve compliant eaves and roof form.
Due to the required changes to the layout it is recommended that a Preliminary Approval be
issued. The Preliminary Approval requires a modified building footprint and changes to the
northern elevation. A Preliminary Approval would require the applicant to submit a further
development application which demonstrates compliance with the conditions of the Preliminary
Approval. Alternatively, the applicant may lodge representations to the Preliminary Approval
seeking that a Development Permit be issued
