    2.0 Introduction

This application follows a previous boundary rearrangement, completed in 2011.

The 2011 application was to remove an encroachment of a pool deck, southward over Lot 392 boundary.

Another boundary rearrangement is required. The boundary is to be moved to the dividing fence which was
constructed in 2016, not on the 2011 boundary alignment.

The fence has come to be accepted as the division between the properties, and native trees and vegetation
screens have grown over time.

Instead of moving the fence to the boundary, the owners wish to move the boundary to the fence, to save
the vegetation, and improve the balance of areas between the lots.

The rationale for this application is stated on the Plan of Development, as follows:

    - Existing boundary is too close to house Lot 392 for the sake of amenity.
    - Existing substantial fence is not on existing boundary.
    - Existing fence is in good position for amenity of Lot 392, and also for Lot 402.
    - Occupation of Lots 392 and 402 to the fence and amenity therefrom has been established since
        2016.
    - Boundary proposed to be moved to the existing new dividing fence. This will ensure that some native
trees can be preserved on proposed Lot 3921.
    - New boundary will improve balance of areas between the two Lots.
    - No disturbance to existing vegetation privacy screens between the two Lots.

The subject Lots are situated in the Low Density Residential Zone identified in the Noosa Plan.

The proposed development requires Code Assessment against the Reconfiguring a Lot Code under the Noosa
Plan.

Lot 402 is also effected by the Bushfire Hazard and Landslide Hazard Overlays.

This Town Planning Report and supplementary documents form the properly made application.

   3.0 Existing Site Conditions

   3.1 Locality Map

    3.2 Zoning Map

The subject Lots are included within the Low Density Residential Zone of the Noosa Plan.

    3.3 Registered Owner

Both properties, Lot 402 on SP246599 and Lot 392 on SP246599, are owned by Brian Gooch (refer
Attachment 2 for copies of the Current Title Searches).

    3.4 Surrounding Land Uses

The subject lots are surrounding by low existing density residential development, from about 1990’s and
2000’s, on all sides.

    3.5 Site Description: Topography

Both Lots have a gentle slope towards their respective street frontages.

The front part of Lot 402 is steeper, captured by the Landslide Risk Hazard Overlay.

Contours appear on the Plan of Development at Attachment 1.

The front portion of Lot 402 is at slope 20%, and the rear is at 8%.

                                                                                                 6|Page
Town Planning Report – 39 Lorilet Street

Page 7

Existing development on the site provides an acceptable solution to addressing the slope.

     3.6 Access and Services

Existing access is by Lorilet Street in the north and Lowry Street in the south, via sealed bitumen kerb and
channel roadways.

Both Lots are serviced by electricity, telecommunications, water and sewerage.

Both Lots drain to their respective street frontages, with roof water drains from their houses.

The proposal to move the boundary to the fence at the rear will not affect any existing services or drainage.

All services are located at the fronts of the Lots near the road.

                                                                                                    7|Page

    4.0 Proposed Boundary Rearrangement

The Plan of Development illustrates the proposal.

The proposal is minor: 23m2 is to migrate from Lot 402 to Lot 392.

No effect on any building or services infrastructure will result by completion of the action.

The proposal has as its aim to preserve the vegetation grown up since previous boundary change in 2011.

As well, amenity for the southern dwelling will be protected, because the fence is the best place for division
of the properties.

Lastly, the balance of areas between the Lots will be improved.

                                                                                                    8|Page

    5.0 Noosa Plan Responses

The land is situated in the Low Density Residential Zone of the Noosa Plan 2020.

Reconfiguring a Lot Code

Low Density Residential Zone requires assessment of the proposal using Reconfiguring a Lot Code.

Assessment is provided in the context of both Lots.

Landslide Hazard Overlay Code: Lot 402

The Plan calls up the Landslide Hazard Overlay for Lot 402, due to the slope of the front part of the lot.

Bushfire Hazard Overlay Code: Lot 402

As well for Lot 402, the Bushfire Risk Overlay applies, that the land might be exposed to National Park
vegetation nearby.

Lot 392: unaffected by Overlays

Lot 392 is unaffected by the two Overlays mentioned above.

Detailed assessment of the relevant Codes mentioned above are provided in Attachments 4, 5 and 6.

                                                                                                     9|Page

    6.0 Conclusion

This Report and its attachments provide all information necessary for the application to be properly made.

The proposal is of a minor nature, where a rear boundary is to be moved approximately one metre to
coincide with an existing fence and maintain existing vegetation, without rebuilding the fence.
