39 Lorilet 0 Gooch Town Planning Report
2.0 Introduction
This application follows a previous boundary rearrangement, completed in 2011.
The 2011 application was to remove an encroachment of a pool deck, southward over Lot 392 boundary.
Another boundary rearrangement is required. The boundary is to be moved to the dividing fence which was
constructed in 2016, not on the 2011 boundary alignment.
The fence has come to be accepted as the division between the properties, and native trees and vegetation
screens have grown over time.
Instead of moving the fence to the boundary, the owners wish to move the boundary to the fence, to save
the vegetation, and improve the balance of areas between the lots.
The rationale for this application is stated on the Plan of Development, as follows:
- Existing boundary is too close to house Lot 392 for the sake of amenity.
- Existing substantial fence is not on existing boundary.
- Existing fence is in good position for amenity of Lot 392, and also for Lot 402.
- Occupation of Lots 392 and 402 to the fence and amenity therefrom has been established since
2016.
- Boundary proposed to be moved to the existing new dividing fence. This will ensure that some native
trees can be preserved on proposed Lot 3921.
- New boundary will improve balance of areas between the two Lots.
- No disturbance to existing vegetation privacy screens between the two Lots.
The subject Lots are situated in the Low Density Residential Zone identified in the Noosa Plan.
The proposed development requires Code Assessment against the Reconfiguring a Lot Code under the Noosa
Plan.
Lot 402 is also effected by the Bushfire Hazard and Landslide Hazard Overlays.
This Town Planning Report and supplementary documents form the properly made application.
