SPECIAL MEETING AGENDA 27 JANUARY 2021
3.3. Statutory Instruments – Planning Scheme
The applications were made under and are to be assessed against the superseded planning
scheme, being The Noosa Plan 2006.
The playground application is code assessable and must be assessed against each of the following
codes to the extent they are relevant to the development:
Cooroy and Lake Macdonald Locality Code
Community Uses Code
Landscaping Code
Engineering Works Code
The car park application is impact assessable and accordingly must be assessed against the whole
of the Noosa Plan to the extent the provisions are relevant to the development.
Locality Provisions
The playground site is located in the Cooroy Locality and is zoned Community Services. The
proposed use is identified as a consistent use with the zone.
The car park site is located in the Cooroy Locality and is zoned Industry. The proposed use is
identified as a consistent use with the zone.
The issues pertinent to the assessment of both applications are discussed below.
Use
Land zoned community services is intended to provide for a range of community services, including
recreational activities to meet the needs of residents. This is reflected in the following overall
outcomes of the Cooroy and Lake Macdonald Locality:
x) The town of Cooroy provides a range of community services, schools, medical facilities,
sporting and recreational facilities, which service the hinterland and beyond;
oo) For the Community Services Zone—land committed or planned for community purposes—
iv. is protected and managed to enable the efficient and timely delivery of community
services; and
v. is consistent with the indoor recreation, education, health, social and safety needs of
the local community, including people with special needs, such as the elderly, children,
low-income earners and disabled persons;
The proposed playground accords with these outcomes as it provides an area where people of all
ages and abilities can socialise and recreate furthering the health and wellbeing outcomes for the
local and broader community. Furthermore, the playground site is currently undeveloped open
space and suitably located within close proximity of the township for a community asset such as
the playground. The playground has also been designed to be inclusive of persons of all abilities.
The car park is to be located on land which is zoned industry. The purpose of this land is to
accommodate the principal industrial centre of the hinterland including businesses associated with
manufacturing, production, storage, repairs and the like to the exclusion of inconsistent uses such
as residential or community uses.
Whilst the car park is located on industry zoned land it is located in an area which currently includes
some hardstand and gravel areas on which informal car parking currently occurs. The proposed
use of this industry zoned land is suitable as it is proposed in association with an existing driveway
and car park for existing industrial uses, and clear of the existing raised building platform,
maintaining a suitable area for future industrial development.
