SPECIAL MEETING AGENDA 27 JANUARY 2021
Sporting fields and open space
Buildings and associated car parking areas
Residential properties
Railway line
To ensure that stormwater runoff associated with the car park and playground is appropriately
treated, the applicant has proposed to install water treatment devices. The treatment
methodologies have been reviewed and supported by Council’s consulting hydraulic engineer.
It is also noted that existing vegetation on the 3 lots associated with the playground is to be retained
with additional planting provided throughout the playground whilst the area proposed for the new
car park does not contain vegetation. Accordingly the development provides for an improved
outcome with regards to vegetation within the Riparian Buffer.
Furthermore, despite proposing development within the Riparian Buffer the proposal provides for
a significant community resource which will be used by many residents within the Shire and
surrounding areas.
Contamination
One of the 3 lots on which the playground is proposed to be located, Lot 3 on SP 230055, was part
of the formal Boral Timber Mill and is listed on the Department of Environment and Science (DES)
Environmental Management Register (EMR) for the following Notifiable Activities:
Wood Treatment and Preservation
Petroleum Product or Oil Storage
Lot 1 and 2 on RP153299 to the north east of the road reserve are not listed on the EMR.
Accordingly an analysis of the soil was taken at a total of 16 locations across the 3 lots.
Concentrations of dioxins and furans were reported exceeding the available guidelines (US EPA
Regional Screening Levels and remediation of soil values in Germany) at three of the sixteen
samples analysed. The three samples relate to differing depths at borehole 27. Based on the
findings from this investigation, the site is considered to pose a potential health risk to site users
based on the results of the dioxin assessment undertaken at the site if left untreated.
To address these potential health risks remedial works are proposed to address the dioxin impact
identified within the vicinity of borehole 27. The approximate extent of impact is approximately
30m3. Further investigations, after the remedial work has been undertaken, is recommended in
order to facilitate the removal of Lot 3 on SP230055 off the EMR. It is recommended that conditions
are included to ensure that the site is suitably remediated.
Extent of playground within the road reserve
The proposal plans detail that the extent of the playground extends beyond the boundaries of the
lots for which the application has been made and includes land within the Maple Street road
reserve. The works within the existing road reserve include part of the event precinct, picnic shelter,
pathways/access and landscaping. In this regard, a Permanent Road Closure application has
been made to the Department of Natural Resources, Mines and Energy (DNRME). On 11
December 2020 DNRME provided letters of offers to Council in relation these applications.
Acceptance of these offers allows for Council to purchase the land and develop the area for the
playground as detailed on the proposal plans. This will result in the land being amalgamated into
the adjoining freehold land and may possibly be completed by early February 2021.
A soil assessment of the road reserve was carried out, and results from sample locations indicate
the proposed development in this area is suitable and does not pose unnecessary risk to
playground users. The assessment of car parking demand was undertaken based on the full extent
of the playground, including the land within the road reserve.
