3.1.5 EPBC Protected Matters
A report was generated using the EPBC Act Protected Matters Search Tool. It noted that there is
potential for 40 Threatened Species and 17 Migratory Species to occur within two kilometres of
the centre of survey area, including Koala (Phascolarctos cinereus) listed as Vulnerable, and
Giant barred frog (Mixophyes iteratus) listed as Endangered.

There is also potential for three listed Ecological Communities to occur within two kilometres of
the site: Lowland Rainforest of Subtropical Australia, which is listed as Critically Endangered
under the EPBC Act, 1999, Coastal Swamp Oak (Casuarina glauca) Forest of New South Wales
and South East Queensland and Coastal Swamp Sclerophyll Forest of NSW and SEQ which are
listed as Endangered.

3.1.6 Protected Plants Flora Survey Trigger map
The Protected Plants Survey Trigger Map is a tool provided by DES in order to identify areas that
may contain EVNT plant species. The trigger map is used to determine when a flora survey needs
to meet the requirements of the Flora Survey Guidelines – Protected Plants (NCA, 1992). Figure
3 shows that the survey area lies within a Protected Plants high risk area and as such, is subject
to the provisions of the guidelines.

3.1.7 Vegetation legislation
The Planning Regulation 2017 and the Vegetation Management Act 1999 regulates the clearing
of vegetation in Queensland. The Planning Regulation 2017, Schedule 10 Part 3 details the
requirements for clearing native vegetation. Schedule 7 details accepted development and if the
proposed clearing complies with an accepted development vegetation clearing code the work
does not require a development application. The proposed works are not considered to fit under
the Accepted development vegetation clearing code - Clearing for Infrastructure (21 June 2019).
