PROPOSAL
The applicant seeks approval to change the existing approval to update the external facades, increase GFA/Use Area, increase car parking onsite and undertake the development in 3 stages.
The proposed changes are outlined below.
Built form
The building footprint remains generally unchanged with the external materials changing to incorporate a more industrial warehouse type of architectural design and a natural tone colour scheme. The roof form is mostly 5 degrees with some parapet areas to add horizontal elements and variety. The external materials include a mix of raw and painted tilt panel concrete, composite timber –look cladding, metal strip cladding and axon cladding. Part of the elevations are shown below in Figure 1.

Figure 1 - Southern elevation of the northern tenancies
Gross Floor Area / Use Area
The proposal seeks to increase Use Area from 3,840m² to 5,769m², an increase of 1,929m². The proposed GFA is 5,590m² (excludes balconies). This has occurred by increasing the size of some tenancies by including mezzanines floors.
Carparking
The current approval is for equivalent to 104 car parking spaces. This has been calculated in accordance with Councils traffic consultant which required the tenancies 150m² or less, a parking rate of 1 space per 30m² and for tenancies greater than 150m², 1 space per 50m². The proposal is for the equivalent to 127 spaces in accordance with the rate mentioned above.
Staging
The application also seeks to undertake the development in 3 stages and has provided a staging plan accordingly. The staging plan is provide as Figure 2 below.

assessment
Instruments for Statutory Assessment
Under the Planning Act 2016 the application must be assessed against each of the following statutory planning instruments to the extent they are relevant to the development:
State Planning Policy;
South East Queensland Regional Plan;
Planning Regulation 2017;
The Noosa Plan.
The following codes from the Noosa Plan are applicable to this development:
Noosaville Locality Plan
Business Uses Code
Landscaping Code
Engineering Works Codes
Statutory Process
The applicant has requested to make a minor change to a development approval under s78 of the Planning Act 2016. An application for a minor change to a development approval can only be made in circumstances where a change would constitute a ‘minor change’.
The proposed change to the development approval requested by the applicant is determined to constitute a minor change on the grounds that:
the development would not result in substantially different development.
Schedule 1 of the DA Rules sets out circumstances that would result in a substantially different development. The most significant is a proposal introducing a new use to a site and dramatically changes the built form is terms of scale, bulk and appearance.  The development is not introducing any new uses and while the development is increasing use area by 1929m², the built form is not changing dramatically as the increase in use area is via new mezzanines within the tenancies and very minor changes in the building footprint;
the change does not include prohibited development;
the change would not require the application to be referred to an additional referral agency or cause a referral agency to have regard to new mattes prescribed by regulation;
where the original application was code assessable, the change would not cause the application to become impact assessable.
Statutory Instruments – Planning Scheme
The original application was assessed against The Noosa Pan and there has been no changes that would affect the assessment of this development. The development remains consistent with the provisions of the planning scheme.
Condition 1 – Approved Plans
Development undertaken in accordance with this approval must generally comply with the approved plan of development. The approved plan is titled and numbered:
Plan / Document No.	Rev.	Plan / Document Name	Date
Sheet No. 1 “Industrial Development at Precinct N Gateway Drive Noosaville” prepared by Herwig Hartl trading as Smartarch	May 2008
and as may be amended by these conditions.
Applicant’s Request
The applicant seeks a new architectural external design which includes new external finishes and mezzanine floor internal to the tenancies and some minor layout changes. A new suite of plans have been provided to reflect the new design.
Assessment of Request
Changes include an increase in total Use area from 3,840m² to 5,769m², an increase of 1,929m². It should be noted the proposed GFA is 5,590m² (excluding balconies). The increase complies with the relevant Planning Scheme Codes as the building footprint remains generally the same. No GFA provisions for the Industry zone applies as the building size is regulated by setbacks, landscaping and the provision of car parking. The increase in Use area is a result of mezzanine floors proposed within the tenancies.
Car parking has been increased accordingly with a slight change to the configuration to include some tandem car spaces. This is discussed further in the body of this report.
The Planning Scheme requires 15% landscaping. The proposal increases landscaping open space from 35% to 37% complying with the Planning Scheme. An existing condition requires a shade tree for each 6 car spaces within the car parking area.
The setbacks remain unchanged and comply with the Planning Scheme being 6m to the primary frontage and 4.5m to a secondary frontage. A 6m setbacks to the western side of the cul de sac is proposed and between 4.5m and 7.7m to the eastern side of the cul de sac.
The external finishes include a range of material finishes which create interest and raise no concern.
Staging
The applicant seeks to construct the development in 3 stages as shown above in Figure 2 in section 1 of this report. Staging the development does not raise any concerns providing the car parking, stormwater quantity and quality can be provided so stage 1 and stage 1 & 2 combined can stand alone. The applicant has demonstrated that carparking can work and Councils water quality officer suggests that it appears that stormwater also could work providing the relevant conditions are amended accordingly which are addressed within the body of this report. Overall, an additional condition in the form of a sunset condition is required to ensure the development is not left partially constructed.
The change to the approved plans have been assessed within the body of this report and raise no concerns and as such Condition 1 is agreed to be changed to reflect the proposed development.

Condition 3 – Landscaped open space
The open space and setback areas are to be landscaped in accordance with Council’s Policy on Landscaping Guidelines and a properly prepared landscape plan prepared by a suitably qualified Landscape Architect or Horticulturalist. Such landscaping is to be completed prior to the premises being occupied and maintained at all times thereafter. The landscaping shall include:
A minimum of 2m width of landscaping adjacent to uncovered parking at the head of the cul-de-sac;
A minimum of 1 shade tree per six vehicle parking spaces;
Dense native screening vegetation within the landscaped buffer adjacent the western boundary (where not located within the easement area) consisting of species with a range of mature canopy heights;
Revegetation of the landscaped buffer along the northern and eastern boundaries; &
Appropriate landscaping / treatment to bin collection or storage areas so that they do not dominate the streetscape.
Applicant’s Request
The applicant requests the following request to Condition 3
3.The open space and setback areas are to be landscaped in accordance with Council’s Policy on Landscaping Guidelines and a properly prepared landscape plan prepared by a suitably qualified Landscape Architect or Horticulturalist. Such landscaping is to be completed prior to the premises being occupied and maintained at all times thereafter. The landscaping shall include:
A average of 2m width of landscaping adjacent to uncovered parking at the head of the cul-de-sac in accordance with the approved Master Floor Plan;
A minimum of 1 shade tree per six vehicle parking spaces;
Dense native screening vegetation within the landscaped buffer adjacent the western boundary (where not located within the easement area) consisting of species with a range of mature canopy heights;
Revegetation of the landscaped buffer along the northern and eastern boundaries; &
Appropriate landscaping / treatment to bin collection or storage areas so that they do not dominate the streetscape.
Assessment of Request
The applicant seeks a minimum landscaping of 1.7m & 1.4m to uncovered car parking and between zero & 0.3m to motor cycle spaces. Considerable landscaping is provided to the frontage which will provide an attractive entry to the development. However, it is considered there is not sufficient landscaping between the boundary and 2 of the closest motor cycle spaces each side of the centrally located entry. Therefore, it is not agreed to change the condition as requested by the applicant. Given the development is in excess of motor cycle spaces, it is considered the condition is changed to delete these 2 motor cycle spaces and replace with garden. The condition to read as follows:
3.The open space and setback areas are to be landscaped in accordance with Council’s Policy on Landscaping Guidelines and a properly prepared landscape plan prepared by a suitably qualified Landscape Architect or Horticulturalist. Such landscaping is to be completed prior to the premises being occupied and maintained at all times thereafter. The landscaping shall include:
A minimum of 2m width of landscaping adjacent to uncovered parking at the head of the cul-de-sac except for car space 12 which must  be setback a minimum of 1.7m and car space 13 which must be setback a minimum of 1.4m. The motor cycle space closest to the each side of the central entry must be removed and replaced with landscaping and include a shade tree;
A minimum of 1 shade tree per six vehicle parking spaces;
Dense native screening vegetation within the landscaped buffer adjacent the western boundary (where not located within the easement area) consisting of species with a range of mature canopy heights;
Revegetation of the landscaped buffer along the northern and eastern boundaries; &
Appropriate landscaping / treatment to bin collection or storage areas so that they do not dominate the streetscape.

Condition 8 – Retail sales
8. The retail sales component of any tenancy shall not exceed 20% of the gross floor area of that tenancy and shall relate to an industry use conducted from that tenancy.
Applicant’s Request
8. The retail sales component of any tenancy shall not exceed the gross floor area requirement of The Planning Scheme for that tenancy and shall relate to an accepted use conducted from that tenancy.

Assessment of Request
The applicant is preparing for the draft Planning Scheme gazettal. The draft Planning Scheme allows greater flexibility for retail use of up to 30% of the GFA of the tenancy and a broader range of uses for the Industry zone. Furthermore, the draft Planning Scheme has a range of uses which are ‘accepted development subject to requirements’ where these additional uses could be integrated into the development. Therefore, it is agreed to remove reference to the 20% but not the requested removal of Industry as the primary use of the site as it is required to ensure the industrial nature of the development. Rather than using’ industrial use’ it is considered acceptable to use ‘approved use’ which ensures the primary use of the development and the intent of the Planning Scheme to be of an industrial nature or those uses the planning scheme in force at the time may allow to be ‘accepted development subject to requirements’. It is agreed to change the condition to read as follows:
8. The retail sales component of any tenancy shall not exceed the gross floor area requirement of the Planning Scheme in force at the time for that tenancy and shall remain an ancillary component of the approved use.

Condition 10 – Bicycle spaces
10. Secure bicycle racks shall be provided on site to accommodate a minimum of 41 bicycles. The proposed bicycle racks shall be identified on the landscaping plans and shall be shall be dispersed across the site to the reasonable satisfaction of Council.
Applicant’s Request
10.Secure bicycle racks shall be provided on site to accommodate a minimum of 45 bicycles. The proposed bicycle racks shall be identified on the landscaping plans and shall be shall be dispersed across the site to the reasonable satisfaction of Council.

Assessment of Request
The applicant suggest an additional 4 bicycle spaces. The Business Use Code requires 1 space per 100m² of GFA which would result in 58 spaces. This is considered excessive and the 45 spaces suggest by the applicant is agreed with.

Condition – Relevant period and staging
22. The Development Permit for a material change of use of premises lapses if the use has not happened by 2 July 2020 unless an application to extend the currency is approved by Council.
Applicant’s Request
22. The Development Permit for a material change of use of premises lapses if the use has not happened by 2 July 2022, unless an application to extend the currency is approved by Council.
Propose an extension for a further two years to allow for potential development staging of the development and to meet market conditions. In support of this request, it is noted the proposed New Noosa Plan still supports this development in the site.
Assessment of Request
It is agreed that the proposal meets the provisions of The Noosa Plan. The draft Noosa Plan seeks the same intent for the site although the site is proposed to be split zoned Low Impact Industry and Environmental Management. The Environmental Management zone reflects the current setback of this proposal.
Given the proposal meets the Noosa Plan and the draft Planning Scheme it is reasonable to extend the time for possible staging of the development. A sunset clause is the usual policy applied for staged development and not just an extended relevant period. The standard of 6 years sunset clause could be integrated into the a timeframe by allowing a further 2 years relevant period and a 4 year completion date as a sunset clause and read as follows:

22. The Development Permit for a material change of use of premises lapses if the use has not happened by 2 July 2022 unless an application to extend the currency is approved by Council.
A staging condition and a sunset clause is required should the development be staged and is provided as 2 additional conditions and read as follows:
Staging
83. Should the development be staged, the staging sequence must be undertaken in accordance with the approved master plan - staging plan.
Sunset Clause for Completion of Approved Development
84. Pursuant to s88(1) of the Planning Act 2016, the uncompleted aspects of this development approval lapses if the whole of the approved use has not happened by 2 July 2026.

Condition 24 - Access
24. Vehicular access to the site shall be constructed from the Gateway Drive frontage of the site generally in accordance with Drawing Job No: M0906, Sheet No: 1 dated May 2008 by Hartland consultants Pty Ltd - Smartarch and as may amended by these conditions.
Applicant’s Request
The applicant seeks to amend the condition to reflect the new plans
Assessment of Request
Agreed.

Conditions  31 & 32 - Car parking
31.Car parking, loading zones and skip bin storage shall be designed and constructed generally in accordance with Drawing Job No: M0906, Sheet No: 1 dated May 2008 prepared by Hartland consultants Pty Ltd - Smartarch.
32.A minimum of 104 uncovered carpark spaces shall be provided on site and shall include:-
3 clearly defined and strategically placed disabled carpark spaces.
A minimum of the equivalent of 3 of the car parking spaces designated for motorcycle and motor scooter parking, to accommodate a minimum of 12 spaces. Motorcycle and motor scooter parking is to be evenly dispersed across the site.
Applicant’s Request
The conditions are required to be changed to reflect the new plans and the increase in the number of car parking spaces throughout the site.
Assessment of Request
Agree.
The proposal plans provide car parking at the rate identified by Councils consultant traffic engineer at the time of the original approval which is 1 space per 30m² for tenancies 150m² or less and 1 space per 50m² for tenancies greater than 150m². Parking in the form of 125 car spaces and 14 motor cycle spaces are proposed.
There are some in tandem spaces which is acceptable for staff car parking.
Proposed Condition 3 requires 2 motor cycle spaces to be removed either side of the central vehicle access which results in 12 motor cycle spaces which is equivalent to 3 car spaces resulting in equivalent to 128 car spaces proposed. The development requires a total of 127 spaces. It is likely the additional space will be removed to comply with the waste bin conditions.

Condition 43 & 44 - Stormwater
43.The treatment train including the gross pollutant traps/oil arrestors, Bio-Retention Basin/Unit and Raingardens shall have three (3) years maintenance period from the date of the accepting the operational works on the site on maintenance.
During the three years maintenance period the applicant shall monitor the quality of the stormwater runoff existing the site to ensure that water achieve the water quality objectives as set out by Council and generally as described by the Stormwater Quality Management and Assessment Report dated March 2007 prepared by Callaghan & Toth. Should the monitoring indicate that the objectives have not been met or indicate that objectives may not be met the applicant shall undertake the necessary works and/or upgrading works to ensure the objectives are achieved on a regular basis.
44.The applicant shall provide a comprehensive ongoing stormwater quality monitoring, management and maintenance program for the stormwater treatment train on the development site including the water tanks and gross pollutants traps (GPTs). The management plan shall be submitted to the Council for approval in conjunction with obtaining a Development Permit for Operational Works.
The approved maintenance plan must be incorporated in the Community Management Scheme for the development and a copy of this shall be provided for Council’s records prior to commencement of the approved Use.
Applicant’s Request
The applicant did not request for these conditions to be changed.
Assessment of Request
The stormwater conditions are required to be changed to ensure the development manages water quality and quantity in accordance with the Noosa Plan and the relevant guidelines and should the development be staged each stage’s stormwater is managed appropriately as a standalone development.

Condition - Unitywater
Conditions 45, 50, 51 and 52 are requested to be amended to reflect the change in reticulated water and sewer asset ownership.

Condition 68 – Infrastructure Charges

In the event that the Development Permit for Material Change of Use of Premises lapses or is cancelled, the paid contributions and/or the trading bank guarantee will be returned.
Applicant’s Request
The applicant seeks the condition to be deleted suggesting it is superseded by an Infrastructure Agreement.
Assessment of Request
Disagree. The infrastructure agreement (IA) does supersede the condition but it is considered that the condition remains to ensure infrastructure changes are paid in accordance with the Planning Act 2016. A new infrastructure agreement is proposed to replace the existing agreement as the development seeks additional gross floor area. The new IA includes the 2 charging regimes in accordance with the Planning Act 2016.
The amended condition is provided track changed below:
