Delegated Report - Code - Planning OPW20 0152
Author Coordinator Engineering, Mark Lewis Development Assessment APPLICATION DETAILS Application No. OPW20/0152 Applicant Hpt 4 Services Pty Ltd Tte Proposal Operational Works - Vehicle Crossover Properly Made Date 9 September 2020 Information Request Date 21 September 2020 Information Response Date 14 October 2020 Decision Due Date 2 December 2020 Report Completed Date 21 October 2020 Number of Submissions Not Applicable PROPERTY DETAILS Property Address 167 Gympie Tce Noosaville Qld 4566 RP Description Lot 1 RP 87781 Land Area 703.0000 m² Existing Use of Land Residential STATUTORY DETAILS SEQRP Designation Urban Footprint Locality Noosaville Zone Medium Density Residential Overlays Acid sulfate soils, flood, Assessment Type Code PROPOSAL The application seeks approval for Operational Works - Vehicle Crossover. site details Background The works are required to provide vehicle access to a proposed new residence on the subject site. The new garaging is approximately 11m wide and setback 6m from the front property boundary. The existing access to the 3 car spaces (2 carport, 1 garage) is not formed and the existing layback in the kerb is approximately 9.5m wide. assessment Instruments for Statutory Assessment Under the Planning Act 2016 the application must be assessed against each of the following statutory planning instruments to the extent they are relevant to the development: State Planning Policy; South East Queensland Regional Plan; Planning Regulation 2017 The Noosa Plan 2020. The following codes from the Noosa Plan are applicable to this development: Driveways and Parking Code The application has been found to generally comply with all applicable statutory instruments. The pertinent issues arising out of the assessment are discussed below: Width of the access. The original submission was for a 9.1m wide access driveway directly from the existing layback. Council considered this width excessive and the applicant, as part of their response to the information request, reduced the width to 4m at the kerb line and 8m at the property boundary. The reduced width at the kerb provides additional on street parking in an area where on street parking is in high demand. The width at the property boundary is more than the 6m indicated on Council’s standard drawings but is considered reasonable in this instance due to: the width and setback of the proposed garaging. It is also noted that the grades of the driveway within the site will need to cater for the higher garage floor level due to the impacts of flooding in the area. the width (kerb to boundary) of the current verge area, and the driveway being located on the longest frontage boundary (34.8m) in the lesser street Filling in the road reserve. Council had concerns with the extent of filling proposed in the road reserve. As part of their response to the information request and in a subsequent response to a further information request the consultant has clarified that the filling shown on the submitted longitudinal section is along the centreline in an area that is lower due to the existing vehicle access. The filling on the edges of the driveway will be minimal to match with the existing verge levels. Conditions have been included to minimise filling and to match smoothly with the existing verge levels. cONSULTATION Referral Agencies Not applicable Other Referrals Not applicable conclusion & reasons for decision The proposed development generally complies with the requirements of the planning scheme and does not raise any significant issues that cannot be addressed by reasonable and relevant conditions. The application is therefore recommended for approval. The report is provided in accordance with Section 63(5) of the Planning Act 2016.
