The following codes from the Noosa Plan are applicable to this development: Medium Density Residential Zone Code Statutory Process The applicant has requested to make a minor change to a development approval under s78 of the Planning Act 2016. An application for a minor change to a development approval can only be made in circumstances where a change would constitute a ‘minor change’. The proposed change to the development approval requested by the applicant is determined to constitute a minor change on the grounds that: the development would not result in substantially different development as the changes are minor in nature, relating to an existing approved use; the change does not include prohibited development; the change would not require the application to be referred to an additional referral agency or cause a referral agency to have regard to new matters prescribed by regulation; where the original application was code assessable, the change would not cause the application to become impact assessable. Statutory Instruments – Planning Scheme The development at the time of the original approval complied with all the relevant provisions of the superseded planning scheme. The superseded planning scheme parameters are similar to that of the Noosa Plan 2020 provisions. Therefore the alterations and additions comply with the superseded planning scheme and considered to meet the provisions of the Noosa Plan 2020. Plot Ratio & Site Cover Table 1 below shows the plot ratio and site cover for the development. Provision Planning Scheme Existing Proposed Comply Plot Ratio 0.4:1 (393m2) 0.29:1 (291m2) 0.31:1 (308.5m2) Site Cover 40% (393m2) 27% (264m2) 29% (280m2) The applicant proposes an increase in GFA of 17.5m2 resulting in a proposed plot ratio of 0.31:1.and a site cover of 29%. The proposed additions include a reconfiguration of the two existing bedrooms on the first floor and the creation of a new private open space area on the first floor in the form of a balcony. Performance Outcomes PO10 and PO11 of the Medium Density Residential Zone Code states Site Cover of development does not exceed 40% of the site area and Plot Ratio of development does not exceed 0.4:1. The proposal does not exceed the allowable site cover and plot ratio. Parapet The proposed minor change includes a parapet at the rear of the property. Performance Outcome PO19 and Acceptable Outcome AO19.3 seek to avoid box profiles/parapets and the total width of any parapet wall does not exceed 50% of the width of the front façade of a building. The proposed parapet does not present to the street and therefore will not affect the streetscape. cONSULTATION Referral Agencies Not applicable Other Referrals Not applicable conclusion & reasons for decision The proposed development generally complies with the requirements of the planning scheme and does not raise any significant issues that cannot be addressed by reasonable and relevant conditions.
