Hi Keri,
I’m just following up on my email below from before Christmas to see if you have any feedback?
2. Submit vegetation clearing application: is there a further vegetation clearing form that needs to be submitted as
part of the further approval required under the RM20205358 Bushfire Vegetation Management Conditional
Approval?
5.f. Infrastructure Agreement: does Council have preferred proforma Infrastructure Agreement we can work from?

Subject: RE: Ozcare Noosa ‐ 100 Cooyar St Noosa Heads
Hi Kerri,
2
Page 3
I just wanted to provide you with an update in relation to the Ozcare project at Noosa Heads (Cooyar Street). Further
to our previous discussions and correspondence below, we have been progressing the project. All the necessary
consultants have been engaged, the site has been surveyed, significant trees (i.e. glossy black cockatoo feed trees)
on‐site have been identified and marked to be retained, and we are progressing the design of the aged care facility
extension, the civil design of the stormwater discharge crossing and the tree clearing approval requirements.
The key steps we’ve identified moving forward are identified in red:
1. Survey of site and marking of trees to be retained
2. Submit vegetation clearing application that:
a. fulfills the requirements of the RM20205358 Bushfire Vegetation Management Conditional Approval
b. includes the survey plan identifying the extent of vegetation to be remove and significant trees (i.e.
glossy black cockatoo feed trees) to be retained
c. includes a civil designed trafficable stormwater discharge solution across the access trail
3. Undertake the clearing once the further approval has been obtained from Council
4. Update the survey plan to identify only trees retained and take aerial photos of resulting cleared land
5. Lodge Minor Change application
a. Town planning request letter
b. Architectural plans
c. Ecology and bushfire assessment
d. Civil plans for trafficable stormwater discharge solution across the access trail and any other required
works on‐site
e. Traffic advice letter showing vehicle manoeuvrability diagrams
f. Draft Infrastructure Agreement identifying that Ozcare is responsible for maintenance of the access trail
The following respond to the items within the correspondence below:
b) Application Pathway
Lot 1 on SP239726 Girraween Nature Refuge (access track lot) owned by Council is in the Environmental
Management and Conservation Zone (Noosa Plan) and SEQ Regional Plan Regional Landscape and Rural Production
Area. It makes up part of a much larger lot and is constrained by various local and state environmental overlays
(remnant vegetation, koala priority area, local refined koala habitat area). The inclusion of this lot within a
development application will unnecessarily complicate and elevate the assessment of the application. Accordingly,
we will be pursuing a Minor Change over just the Ozcare land Lot 1 on RP225312 and enter into an Infrastructure
Agreement with Council regarding the works and on‐going maintenance of the access track.
c) Bushfire Vegetation Management on Council land
We will be submitting a further application to Council for approval by Council in accordance with the attached
RM20205358 Bushfire Vegetation Management Conditional Approval to undertake the clearing works prior to the
development application being lodged. This application will satisfy the requirements of the RM20205358 Bushfire
Vegetation Management Conditional Approval, provide a survey plan that identifies the significant trees (i.e. glossy
black cockatoo feed trees) to be retained and a civil engineered design that rectifies the stormwater discharge issue
over the access trail.
Please note that the attached RM20205358 Bushfire Vegetation Management Conditional Approval dated 7 October
2020 only had a limited currency period, but we have been in discussions with Council and working on this project
for sometime. Can you please confirm that there will be no issue applying for a further approval for clearing works
under this conditional approval?
Can you please confirm receipt of this email and direction identified?
Please call me on my mobile if you wish to discuss.
Kind regards,
Ashley

Hi Kerri,
I wish to consolidate and confirm Council’s advice to enable Ozcare to move forward with the preparation of a
development application. Can you please review and confirm the below, please make any minor changes as
required.
5
Page 6
a) Temporary Access: Council agrees to the use of Council’s land (Lot 1 on SP239726) for temporary
construction access, generally in accordance with the below subject to retention of glossy black feed trees.
The Applicant should contact Denis Wallace (Property Advisor, Noosa Council, 5329 6239,
[email protected]) to arrange the relevant consent. The construction access route
commences within the Ozcare land (Lot 9 on RP 225312) carpark, it then makes its way to the Council land
access path via an existing driveway next to the existing shed (to be removed and replaced with a refuse
storage and collection area), access to the development area is then available via the existing Council access
path. Construction access will be approved through the development application process, no need to
contact property separately.
6
Page 7
b) Application Pathway: Council’s preference is for a development application to be lodged over both the
Ozcare land and Council land to accommodate the bushfire mitigation within the approval – this would
require a Change ‘Other’ Application to development approval 21675 DA dated 7 December 2005, due to the
application applying to a new parcel of land (i.e. the Council land). The Applicant should contact Denis
Wallace to arrange the relevant consent to lodge the application over Council land. However, if there are any
issues with the regional planning designation of Council’s land and the ability to lodge a development
application, Council will agree to the preparation of an Infrastructure Agreement, at Ozcare’s expense, that
stipulates the requirements of the above – this would involve a Minor Change Application to development
approval 21675 DA as there would be no new land parcel added to the application – check that there are no
new referral agencies and meets the test of a minor change.
c) Bushfire Vegetation Management on Council land: Council agrees in principle to the use of Council land for
bushfire vegetation maintenance, maximum total width of 20m comprising 15m as a fire access trail width
and 5m fuel reduction zone. The clearing of glossy black cockatoo feed trees should be avoided, see further
details below. The attached RM20205358 Bushfire Vegetation Management requires a further application to
Council for approval by Council to Conditional Approval allows Ozcare to undertake the clearing works prior
(in addition to the attached Bushfire Management Condition Approval) to the development application
being lodged to protect existing infrastructure and building works on site and people.
Council’s endorsed Noosa Bushland Reserve Strategic Fire management Plan permits a 20m wide
area in Council’s land comprising 15m as a fire access trail width and 5m fuel reduction zone for the
nursing home.
This means all vegetation is cleared within the 15m Fire Access Trail or the Fuel Free Zone, then 5m
Fuel Reduction Zone. Fuel Reduction Zone requires understorey and mid‐storey vegetation removed
but mature trees(those with stem diameter greater than 200mm) are retained, lower branches of
mature trees in this zone should be lift pruned (in accordance with AS 4973 ‐ Pruning of Amenity
Trees) to 2m above ground level to prevent fires moving from ground into tree canopy. The below
image provides some guidance for the Fuel Reduced/Reduction Zone:
7
Page 8
’
As stated in the FMP, Fire access trails need to be well formed (natural surface) drained and works
still need to achieve biodiversity outcomes. For instance, further investigation by the applicant would
need to be conducted in the northern & southern sections with regards to potential glossy black
cockatoo feed trees and if deemed present retained.
To properly aid emergency access, piped drainage from this development currently hinders vehicle
throughfare, see below aerial image. It would be beneficial if this infrastructure was extended (or
removed altogether) to allow complete access

Page 9
Further investigation though is needed at the south eastern and northern corners and investigation
of feed trees for glossy black cockatoos – where feed trees exist, clearing should be avoided and
where necessary fire management mitigation measures should be undertaken on the Ozcare site.
