Dear Matthew,

RE Proposed Commercial Development, 37 Gibson Road, Noosaville - Response
to Information Request Section 5 (Noise)

The following letter is in response to Sunshine Coast Regional Council's information request
(application ref: MCU10/2083) dated the 8th of December 2010, referring specifically to
section 5, relating to noise.

Council Request

 Issue
The submitted acoustic report relies primarily upon management measures to comply with
the relevant acoustic criteria. The proposed management measures are generally an
undesirable option and rely heavily upon a number of different tenancies complying with the
required measures to prevent noise impacts upon adjacent residential uses. Management
measures also require additional Council resources to monitor and respond to any noise
complaints received and enforcement of any conditions imposed.

 Information Required:
5 Demonstrate that noise from the proposed use can be managed through structural
measures, design and layout. The provision of revised site layout plans and
architectural drawings along with a revised acoustic report will be required to
        demonstrate the above.

Our Response
Since the initial submission of the acoustic report (ttm ref.- 26906 R06 37 Gibson Rd
Noosaville ENV), the proposed hours of operation have changed to 7am to 10pm, 7 days per
week. Given the proposed hours of operation do not include the night period (10pm to 7am),
management controls restricting night time use are no longer required.

A revised acoustic assessment (ttm ref 26906 R07 37 Gibson Rd Noosaville ENV) was
undertaken to reflect the proposed hours of operation. Acoustic barriers were specified to
ensure predicted noise levels associated with outdoor patron areas (i.e. Tenancy 1 and 8
outdoor decks) comply with the day and evening criteria. Management controls shall be
required only for the management of noise associated with tenancy staff operating at the rear
of the centres tenancies. Experience with similar developments within Queensland have
utilised this practice and found it to be an acceptable way of management noise impacts.

In relation to waste collection, structural measures to control noise are impractical as it would
require acoustic barriers along the street frontage. Noise impacts from waste collection are
unlikely to be a cause of annoyance, given that they are generally an infrequent occurrence
