Dear Sir/Madam,
On behalf of our client, we request Council to consider the following justification for a
proposed minor change to the most recent Minor Change Approval (51986.3023.02).
The proposed amendments (alteration) to the existing Multiple Dwelling are
specifically the upper-level roof top terrace pergola.
Exiting:
- The existing size of the pergola is 11.46m2. The pergola is an open structure.
Proposed:
-The proposed includes a 11.46m2 new timer pergola, the shape is rectangular with
clear sheeting over the new structure. The overall height is 2.651m to match the
existing height and to include new cabinetry and shower. A 1.2m solid wall will with
screening on top is to be include.
The proposed is requested to include a more usable and functional area that would
not create the appearance of additional bulk or height.
- The proposal meets the definition of ‘minor change’ to a development approval
under Schedule 2 of the Planning Act 2016:
• This change is not and does not result in a different development.
• The change would not cause prohibited development
• No referral agency required
• No public notification required
- The proposed change is not considered a ‘substantially different development’ as
outlined under the Development Assessment Rules version 1.2:
• The minor change does not result in a substantially different development.
• Development is not resulting in a new use, new parcel of land, change in built form,
impact on traffic or increased impact on neighbours or infrastructure.
