PLANNING & ENVIRONMENT COMMITTEE MEETING AGENDA 7 SEPTEMBER 2021
1. PROPOSAL
The applicant seeks that the Council agree to a request to accept an application for Community Use
Wellbeing Type 2 – Social and Ancillary Dwelling Unit under the superseded planning scheme (SPS),
being the Noosa Plan 2006.
The applicant submits that the proposed community use is to be located on the ground floor and will
provide a hiring venue space and running social, leisure and artistic programs and workshops and
will have a gross floor area of 232m2. The proposed ancillary dwelling unit will be located on the first
floor and will have a gross floor area of 150m2.
The applicant submits that the caretaking component (ancillary dwelling unit) will be incidental to and
necessarily associated with the dominant community use by virtue of the operating hours and the
need to effectively manage the on-site community activities and premises including:
Property and landscape maintenance
Cleaning
Ensuring security of the premises
Administration of bookings with community groups
Supervision of community groups and programs outside of normal business hours
Liaison with community groups
Disability support and advocacy
Running, administering and managing a variety of artistic and community cultural programs
and workshops
The proposed venue will be available for community activities to operate 7 days per week according
to demand from between around 8.30am and 9pm. The request is sought under the superseded
planning scheme for the following reasons:
The effect of Noosa Plan 2020 was to change the zoning of the subject land from the Community
Services Zone to the Innovation Zone. The zoning change has substantially altered the development
potential of the land from community use to a quasi-business zone. The effect of the change is to:
a) raise the level of assessment of a Community Use (Well-Being Type 2) from a consistent, code
assessable use within the Community Services Zone, to an inconsistent, impact assessable use
within the Innovation Zone, thereby causing a conflict with the purpose of the Innovation Zone and
effectively precluding the development of a Community Use within the Innovation Zone;
b) reduce the permissible gross floor area for an Ancillary Dwelling Unit (Caretaker’s
accommodation) from 150m2 in the Community Services Zone to 65m2 in respect of a Caretaker’s
Accommodation in the Innovation Zone;
c) raise the level of assessment of an Ancillary Dwelling Unit from a consistent, code assessable use
within the Community Services Zone, to an inconsistent, impact assessable use for a Caretaker’s
Accommodation that exceeds a gross floor area of 65m² in the Innovation Zone;
d) reduce the overall potential site cover and building footprint area on the subject land. Comparative
code compliant development proposals for the subject land. See Attachment 2.
The reduction in achievable site cover and building footprint area is a direct consequence of
achieving compliance with PO13 and AO13.1 of the Innovation Zone Code that require car
parking to be located behind the front building line or front building setback and to be screened
from view of the street. This contrasts with S9.1 and O9 of the Driveways and Car Parking
Code of the superseded planning scheme that requires parking areas to be accessed from
rear laneways where practicable and parking areas to be located where they will not dominate
the streetscape.
