PLANNING & ENVIRONMENT COMMITTEE MEETING AGENDA 7 SEPTEMBER 2021
(f) is about the relationships between, the location of, or the physical characteristics of, buildings,
works or lots, if the yield achievable is not substantially different from the yield achievable
before the change; or
(g) is made under section 276(1)(c) to identify all or part of a local government area as a party
house restriction area
Notably for (f) above, the yield achievable is not substantially different from the yield achievable
before the change, in relation to building work for a residential building, if the gross floor area of the
residential building - (a) is not more than 2,000m2; and (b) is reduced by not more than 15%.
The applicant submits that the commencement of the Noosa Plan 2020 and inclusion of the land
within the innovation zone has prejudicially affected the development potential for the intended uses
to such an extent that the new zoning constitutes an adverse planning change.
It is considered that while the Noosa Plan 2020 provisions are different to the Noosa Plan 2006
provisions for the site, it is not considered that the changes are an adverse planning change and/or
the yield is not substantially different from the yield achievable under the Noosa Plan 2006.
The current owner is an affected owner, having purchased the site prior to the commencement of
the Noosa Plan 2020. However, in the circumstances the owner is unlikely to be successful in an
application for compensation were the request refused.

5. CONCLUSION & REASONS FOR DECISION
It is concluded that while the Noosa Plan 2020 has made some changes to the planning scheme
provisions that are applicable to the site, it is not considered that these changes have resulted in an
adverse planning change pursuant to the Planning Act 2016 and therefore it is recommended that
the request be refused.
