PLANNING & ENVIRONMENT COMMITTEE MEETING AGENDA 7 SEPTEMBER 2021
The red line in the following image details the required setback of 6 metres. The blue line details the
recommended 5 metre setback for the roofs. It is noted that sun protection is not critical as this area
faces south-east. Notwithstanding, the recommended 5 metre setback allows for 1.0 metre eaves.
Accordingly, it is recommended that condition be amended to read as follows:
3. The building must be setback a minimum of 6m from the front boundary to Ferguson Street
except for the roofed overhangs which may be setback 5 metres from the front boundary.
3. CONCLUSION & REASONS FOR DECISION
The applicant has made representations to condition 3 which requires the building, including roofed
terrace, to be setback 6 metres from the front boundary. It is noted that there are a number of front
setback variations attributed to carports and garages, within proximity of the site, which are situated
close to or on the front boundary. However, there is only one example of an upper level setback
intrusion, which is minor. Noting the historical development pattern within the area whereby eaves
were previously permitted to intrude 600mm within setbacks it is acknowledged that some form of
variation is reasonable. In this regard, a 1.0 metre intrusion is considered to remain respectful of the
streetscape and allow for the design outcome sought by the applicant to be achieved.
