This report is based on the QLD Government’s planning report template (Department of
Infrastructure, Local Government and Planning), which adopts a ‘report-by-exception’ approach. The
planning report only discusses the key issues and matters where a proposed development does not
exactly meet the requirements of, or conflicts with, a planning scheme or other planning instrument.

4.0 Planning assessment
4.1 Key issues
The proposed use is located within an existing building approved and constructed in 1996 (3B-452)
and is a consistent code assessable development. No external works are proposed to the building
and signage will comply with the relevant Local Law.
4.1.1 Carparking
The Driveways and Carparking Code requires sufficient parking to be provided onsite for the specific
business type/nature of the use, with consideration given to any existing parking onsite, hours of
operation, likely number of users and peak parking demand periods. The site was originally approved
as a showroom, with condition 5 of the original approval requiring 74 car parking spaces on the site
for the 8 tenancies within two separate buildings.
The internal gross floor area for all buildings totals 1,859m2, which equates to a carparking rate of 1
per 25m2. It is noted the 1990 planning scheme required a car parking rate of 1 per 30m2 of use area
for showrooms. The current planning scheme seeks for shops to include a carparking rate of 1 per
50m2 of gross floor area and 1 per 20m2 of a shop, as shown below.
Considering these carparking rates under the 1990 scheme compared to the current parking
requirements, there is an oversupply of parking on the site.
Unit Size m2 Parking Rate 1990 Parking Rate 2020
1 per 30m2 1 per 50m2
1/1 210 7 4
2/1 200 7 4
3/1 197 7 4
4/1 225 8 5
1/3 259 9 5
2/3 261 9 5
3/3 268 9 5
4/3 242 8 5
Total 1,859 62 37
The site provides for sufficient parking on the site for the proposed shop use (1 per 20m2 carparking
rate) and complies with the Carparking and Driveways as well as the Recreation Activities Codes
parking requirements.

6.0 Conclusion
This application seeks a development permit for a Material Change of Use for a shop at 2/1 Gibson
Rd, Noosaville. The proposed use within the existing showroom is a consistent code assessable
development within the Dirstrict Centre Zone.
The Planning Act 2016 prescribes that a code assessment must be carried out only—
(a) against the assessment benchmarks in a categorising instrument for the development (The Noosa Plan 2020); and
(b) having regard to any matters prescribed by regulation.
Council, after carrying out the assessment—
(a) must decide to approve the application to the extent the development complies with all of the assessment benchmarks for
the development; and
(b) may decide to approve the application even if the development does not comply with some of the assessment benchmarks;
and
Examples—
1 An assessment manager may approve an application for development that does not comply with some of
the benchmarks if the decision resolves a conflict between the benchmarks.
2 An assessment manager may approve an application for development that does not comply with some of
the benchmarks if the decision resolves a conflict between the benchmarks and a referral agency’s
response.
(c) may impose development conditions on an approval; and
(d) may, to the extent the development does not comply with some or all the assessment benchmarks, decide to refuse the
application only if compliance cannot be achieved by imposing development conditions.
Example of a development condition—
a development condition that affects the way the development is carried out, or the management of uses
or works that are the natural and ordinary consequence of the development, but does not have the effect
of changing the type of development applied for
The assessment finds the development fully complies with all Acceptable Outcomes of the applicable
codes. The Assessment Manager’s favourable consideration of the above development application
is therefore recommended.
