Information Request OPW21 0256
Officer: Laurie Schreck Direct Telephone: 07 53296223 Our Reference: OPW21/0256 Your Reference: OPW21/0256 23 September 2021 Total Concept Homes P/L C/- Cadcon Surveying & Town Planning PO Box 5774 MAROOCHYDORE BC QLD 4558 [email protected] Dear Madam Information Request Planning Act 2016 I refer to your application and advise that Council requires further information to satisfactorily assess the proposal. application details Application No. OPW21/0256 Street Address: 108 Black Mountain Range Rd Black Mountain Qld 4563 Real Property Description: Lot 2 RP 131369 Planning Scheme: Noosa Plan 2020 (25 September 2020) INFORMATION REQUIRED The information requested is set out below: Issue – Driveway Lower Embankment The submitted Revision B plans do not clearly detail the inclusion of the lower retaining wall between Chainages 70m and 90m. The finished surface contours on the Road Work Layout plan indicate the inclusion of a retaining structure between these chainages but no other notes are provided to suggest the retaining wall is to be constructed. The Sections plan includes a single note for a Rock Gabion Retaining Wall at Chainage 90m however the relevant sections (between 70m and 90m) do not illustrate the inclusion of a retaining structure. Information Required Please amend the plans to clearly identify the retaining wall in the subject location in accordance with the higher order Slope Stability Report and Condition 9 of the Negotiated Decision Notice of RAL21/0003. Issue – Weed Management Condition 6a specifically states ‘clearing and control of declared plants’. The Vegetation Management Plan (VMP) under section Estimated Schedule allows one follow up treatment. I would advise that the area must be treated and assessed until declared plants have been controlled. Information Required Review and update VMP wording within Weed Management – Estimated Schedule to include the wording ‘treatment and assessment must continue until declared plants have been controlled’ (or similar). Issue – Weed Management Performance Criteria VMP: Table 1 – Performance Criteria states the criteria for achieving a minimum coverage of weed species. I would advise that a statement also be included within the VMP that identifies the General Environmental Duty of the landowner to maintain and remove weed species (Biosecurity Act 2014). Information Required Update VMP to include a statement that under the Biosecurity Act 2014 the landowner is responsible for biosecurity matters on their land. Issue – Restoration Performance Criteria VMP: Table 1 – Performance Criteria includes ‘Plants have achieved >90% survival rate and are observed to be actively growing’. It is advised that further detail be included as currently certification could be supplied immediately following ‘active growth’ however the plants may not have achieved enough growth to withstand harsh conditions i.e. drought. Information Required Review and update the VMP to further identify the performance criteria for how the plants will survive during harsh conditions rather than just the >90% success rate and active growth. For example the plants must show continued active growth and >90% survival post wet and dry seasons. Issue – Veg Restoration Maintenance The VMP does not include a details of maintenance following planting. Information Required Review and update the VMP to include maintenance activities i.e. weeding, watering, pruning, mulching, debris. Issue – Fencing to Protected Area Condition 7a) of the higher order approval (RAL21/0003) details specific stock proof to prevent domestic animals grazing in the area. Information Required Provide additional details within the VMP detailing the requirement for the fencing to be stock proof and requirements of not allowing stock to graze within the covenant area. Issue – Fence Details The Fencing section within the VMP states fence specifications a, b and c with b specifically stating ‘3 strand plain wire (no barbed wire)’. The following sentence then details 3 strand wire and or hinge joint wire fencing. Condition 7b)iii) of the higher order approval requires regular opportunities for passage over and through. Hinge joint wire fencing does not allow for adequate passage through. Information Required Update the VMP to remove the reference to the proposed use of Hinge Joint wire fencing. due date for response to information request The due date for providing the requested information is 30 December 2021.
