EXECUTIVE SUMMARY

RECOMMENDATION
That Council note the report by the Property Officer to the Services & Organisation Committee
Meeting dated 6 July 2021; and
A. Authorise the Chief Executive Officer to enter into tenure renewal negotiations with community
organisations noted in Attachment 1, in accordance with the Community Purpose Land and
Infrastructure Tenure Policy; and
B. Apply the exception to the requirement for tendering under Section 236 (1) (b) (ii) of the Local
Government Regulation 2012 for disposal of a non-current asset other than by tender or
auction if the valuable non-current asset is disposed of to a community organisation.
REPORT
The purpose of this report is to seek Council approval to enter into tenure negotiations with eight
community organisations listed in Attachment 1, seven of the community tenure agreements will
expire prior to June 2022 with one being a new lease agreement. The tenure agreements will be
renewed and negotiated in accordance with the Community Purpose Land and Infrastructure Tenure
Policy endorsed by Council at the March 2015 Ordinary Meeting.
In accordance with the Local Government Regulation 2012 section 236, Council may enter into a
contract to dispose of an interest in a non-valuable asset including the granting of a lease over land
or a building without completing the tender process section 228 prescribes, if a relevant exception
applies.
Accordingly, the relevant exception is referenced in Section 236 (1) (b) (ii) whereby Council is not
required to tender of these properties as the purpose of the tenure renewals are to community
organisations. The requirement of this exception is that a relevant Council resolution is first obtained.
Previous Council Consideration
