1. Summary
RG Strategic has prepared this development application on behalf of KX Pilates. The subject site is
located at Unit 1, 8 Venture Drive, Noosaville 4566, and is formally described as Lot 1 on BUP105301
as shown on Figure 2 Site Plan.
The purpose of this report is to seek approval for a Development Permit for a Material Change of
Use for an Indoor Sport and Recreation use.
The site is included in the Medium Impact Industry Zone within the Noosaville locality of the Noosa
Plan 2020. An application of this nature within the Medium Impact Industry Zone and Venture Drive
Enterprise Precinct triggers Code Assessment.
The proposed use will be located within the existing building located within the Venture Drive
Enterprise Precinct of the Noosaville Industrial Estate. The existing building is intended to remain
unchanged as part of this proposal with the exception of a minor internal reconfiguration. The
proposed pilates studio comprises:
• 46m2 of reception area,
• 96m2 of pilates reformer area including 14 x reformer beds, and
• 64m2 of amenities, storage and office area.
The proposed development of this site constitutes ‘development’ as defined by Schedule 2 of the
Planning Act 2016. This report demonstrates that the proposed Material Change of Use of Premises
for an Indoor Sport and Recreation use (KX Pilates) is permitted.
This planning report provides greater detail of the nature of the proposal, describes the site
characteristics and surrounding land uses, and provides a statutory assessment against the intents
and code requirements of the Noosa Plan 2020. These matters are set out in;
• Proposed development intent;
• Description of the characteristics of site and surrounds;
• Proposed development details;
• An assessment of the proposal against the State planning interests;
• An assessment of the proposal against the Noosa Plan 2020; and
• A conclusion that summarises the grounds which support the proposed development.
This report should be read in conjunction with the accompanying covering letter, DA Form 1 and
Appendix A Proposed Site and Use Plans. This report comprehensively addresses the merits of the
development with regard to the provisions of the Noosa Plan 2020 and other relevant matters as
prescribed in the Planning Act 2016. The development is appropriate and is not anticipated to
impact upon the amenity of the locality. Council’s approval of the application is therefore sought,
subject to relevant and reasonable conditions.

5. Proposed Development Details 5.1 Material Change of Use This application is seeking a Development Permit for a Material Change of Use to establish a Pilates Studio (Indoor Sport and Recreation use) on the site. The proposed Pilates Studio (KX Pilates) is a consistent use as defined within the Noosa Plan 2020. The use will occupy Unit 1 within an existing industrial duplex complex and no alteration to the external built form is proposed. The proposed use represents an appropriate reuse of the existing vacant tenancy. The proposal includes a reconfiguration of the internal layout of the unit and external layout of the carparking area and line marking as illustrated within the Proposed Site Plans prepared by RG Strategic (Appendix A). Pilates can be extremely beneficial - physically, mentally and emotionally. It can be suitable for recovery from injury, injury prevention, pre- and post-natal, general fitness and wellbeing, and is a safe and effective exercise method, suitable for all levels of fitness. Photograph 2 illustrates the typical studio layout of the reformer beds at KX Pilates. Photograph 2: Typical KX Pilates Studio Layout (12-14 Beds) Source: KX Pilates KX Pilates will offer timetabled small group classes limited to 12-14 clients at one time to provide high quality movement education to their clients. During the day when group classes are not in operation, private sessions will be available to clients for 1 to participants. RG Strategic Town Planning Report – Indoor Sport and Recreation 8
Page 11
Hours of Operation
To accommodate the demands of the public, the studio proposes to open as below:
• Monday – Friday 5:15AM – 7.30PM, and
• Saturday - Sunday 6:00AM – 12:00PM.
Peak class times are before work between 5:30AM – 8:30AM and after work between 3:00PM –
6:00PM. In conjunction with the small class sizes, the starting time of the classes have been
staggered so that they do not coincide with the peak use of the other tenancies on site. Group and
private classes will be 50 minutes in duration.
An example of the timetable proposed, taken from KX Pilates in Mooloolaba, is provided below.

Proposed Use Area
The proposed development is intended to be established in accordance with the proposal plans
provided at Appendix A – Proposed Site Plan. The Site Plan identifies the reformer studio, reception,
and amenities areas located within the Pilates studio. KX Pilates will comprise of:
• 46m2 of reception area,
• 96m2 of pilates reformer area including 14 x reformer beds, and

5.2 Operational Aspects of the Proposed Development
Studio Operation
KX Pilates will provide timetabled group and private Pilates classes (refer to Table 4 Example Studio
Timetable). Specialising in Reformer Pilates, the focus is providing whole body sequencing,
functional strength and movement training to all clients. A Reformer is a bed-like frame utilising
spring loading to create resistance which builds strength, conditioning, stamina and power.
Examples of pilates training is illustrated in Photographs 3 and 4.

Source: KX Pilates Source: KX Pilates
It is proposed that the studio will operate 7 days a week, with operating hours from 5:15AM through
to the last class commencing at 6:30PM to accommodate a range of clients and their availability.
This operating model allows classes to be staggered throughout the day and to be offered at times
which suit the customers.
The proposed operating hours are consistent with the other existing Indoor Sport and Recreation
uses, as well as the business, retail and dining uses within the Noosaville Medium Impact Industry
Zone and Venture Drive Enterprise Precinct.
RG Strategic Town Planning Report – Indoor Sport and Recreation 10
Page 13
Amenity
KX Pilates will utilise background music with their classes. However, the proposal does not include
music associated with high intensity workouts that are common with gym operations; for example,
F45 Training. Noting that the use is located in an existing concrete tilt slab industrial unit; is located
within the Noosaville industrial estate; and the premises has limited openings; it is surmised that the
proposed use will not negatively impact on the industrial nature of the area.
The nearest residential property is approximately 150 metres away, so no impact on residential
amenity will be associated with the proposed use.
Staffing
One (1) staff member will be available on site during opening hours to assist with member inquiries,
and to provide the following programs:
• Pilates body assessments,
• Personal and group classes, and
• Specialised training.
Carparking
As illustrated within the Site Plans (Appendix A) prepared by RG Strategic, a minor reconfiguration
to the internal layout is proposed to accommodate the Indoor Sport and Recreation use. It is noted
that several areas of the studio do not contribute to actual car parking generation, and these
include the reception, office, amenities and storage areas of approximately 110m2.
The carparking requirements have been calculated utilising the rates prescribed within the Noosa
Plan 2020 (Table 9.4.1.4) and are listed in Table 6.
Table 6: Prescribed Carparking Requirements

Units 1 and 2 at 8 Venture Drive are currently serviced by 12 x car parking spaces. A total of 12 car
parking spaces are currently shared between Units 1 and 2. By reconfiguring the existing carpark
and line markings, a total of 15 equivalent car parking spaces are proposed. This includes the
provision of 1 (one) space for a service delivery vehicle and 4 (four) motorcycle/scooter parks.
Therefore, no additional carparking infrastructure is required resulting from the proposed Material
Change of Use.
RG Strategic Town Planning Report – Indoor Sport and Recreation 11
Page 14
Class Participant Numbers As the proposed Indoor Sport and Recreation use is located within an existing industrial tenancy and the provision of car parking can not be increased further than that which is already proposed; it is recommended that class participant numbers are limited in order to ensure sufficient parking is provided to meet the reasonable requirements of the land use. It is proposed that Units 1 and 2 share the existing car parking spaces during operating hours from 5:00AM to 3:00PM. From 3:00PM onwards, Unit 2 (First Batch Coffee) is not operating/open to public and as such additional car parks are available to be utilised by Unit 1 (KX Pilates). It is considered reasonable to apply the car parking demand rate of 0.8 spaces per client supported by Council in numerous Delegated Reports for Indoor Sport and Recreation uses, including MCU21/0106 – FitStop Noosa. This rate is based on circumstances where most customers drive their own cars, but there is a small amount who will ride share, carpool, or utilise active and public transport modes. Applying the above ratio: with 10 spaces allocated to Unit 1 (refer to Table 6 above) and a maximum of 12 participants, at a car parking rate of 0.8; this equates to 9.6 spaces which are to be provided. Further, with 14 spaces available from 3:00PM, at a car parking rate of 0.8; there is sufficient car parking for a maximum of 17 participants on the site. By reducing the class participant numbers until 3:00PM to 12 ensures that sufficient car parking is available on site whilst both tenancies are open. Refer to Section 7.5 for Conditions which could be included in Council’s Decision Notice of Approval to enable sufficient car parking to be provided for both tenancies. RG Strategic Town Planning Report – Indoor Sport and Recreation 12
Page 15
6. State Planning Interests 6.1 Planning Act The Planning Act 2016 (‘the Act’) is the relevant statutory instrument under which development applications are assessed by local governments. In respect of the proposed development, a Code Assessable development application is made in accordance with s. 51 of the Act. 6.2 Referral Agencies and State Development Assessment Provisions Referral matters for this proposal have been assessed against the provisions of Schedule 10 of the Planning Regulation 2017. Given that the proposed Indoor Sport and Recreation use is to be located within an existing building, no major alterations to the building are proposed, and no referral triggers are identified within the Development Assessment Mapping System; the State Development Assessment Provisions are not applicable to this code assessable development application. As such, no further assessment is required and referral to SARA is not activated by this application. 6.3 State Planning Policy Stated within part 2.1 of the Noosa Plan 2020, the State Planning Policy (SPP) July 2017 has been appropriately integrated within the Noosa Plan 2020. Therefore, assessment against the SPP is not required. 6.4 South East Queensland Regional Plan 2017 The South East Queensland Regional Plan 2017 (SEQRP) guides land use and development in the region. The subject land is located within the Urban Footprint and does not trigger referral to SARA and no further assessment is required. RG Strategic Town Planning Report – Indoor Sport and Recreation 13
Page 16
7. Noosa Planning Scheme Considerations
7.1 Proposal Definition
The proposed development has been defined under the Noosa Plan 2020 as;
Indoor Sport and Recreation
Indoor sport and recreation means the use of premises for a leisure, sport or recreation
activity conducted wholly or mainly indoors.
Comment: The proposed development is consistent with the above definition.
7.2 Level of Assessment
In accordance with the Assessment Table 5.5.10.1 for the Medium Impact Zone and within the Venture
Drive Enterprise Precinct, an Indoor Sport and Recreation use is subject to Code Assessment.
7.3 Applicable Development Codes
Pursuant to Table 5.5.10.1 Development Assessment for the Medium Impact Industry Zone and
Venture Drive Enterprise Precinct, the following development codes are applicable to the proposed
Indoor Sport and Recreation use:
• Noosaville Local Plan Code,
• Medium Impact Industry Zone Code,
• Recreation Activities Code, and
• Works Code.
Noosaville Local Plan Code
The subject site is located within the Noosaville locality. An assessment of the proposed
development against the relevant performance outcomes of the Noosaville Local Plan Code has
been undertaken. The proposed Indoor Sport and Recreation use is located within an existing
building. No changes to the external built form so as to the materiality or design are proposed. As
such, assessment against the Performance or Acceptable Outcomes listed within the Noosaville
Local Plan Code are not relevant or applicable to the proposed development.
However, an assessment against the relevant Purpose and Overall Outcomes for the Noosaville
Local Plan Code is provided below.
RG Strategic Town Planning Report – Indoor Sport and Recreation 14
Page 17
7.2.4.2 Purpose and Overall Outcomes
Noosaville
(1) The purpose of the Noosaville local plan code is to provide locally relevant planning provisions for
the assessment of development within the Noosaville local plan area.
(2) The following overall outcomes apply to the Noosaville local plan area:
(o) Development in the Low impact industry zone and the Medium impact industry zone
accommodates a broad range of industry and business uses, avoiding negative impacts on
the amenity of nearby residential areas.
(p) Activities in industry zones provide important services and products to the community
and provide a range of employment types.
Comment: The proposed Indoor Sport and Recreation use is a reuse of an existing industrial
tenancy. The proposed development is compatible with the existing nature and character of
Noosaville Industrial Estate. The use presents a low intensity use of the site and does not pose any
adverse impacts on the surrounding retail and commercial businesses. As demonstrated by the
Example Timetable (Figure 4) the client attendance will be generally outside of peak business hours.
Therefore, the proposed use will not negatively impact upon the existing uses within the Venture
Drive Enterprise precinct, nor surrounding Medium Impact Industry uses.
Sufficient carparking infrastructure will be provided to meet the demands of the proposed Pilates
Studio as demonstrated by Table 6. The use will not produce excessive noise or, odour, or other
waste. The proposed use is consistent with the Purpose and the relevant desired Overall Outcomes
for the locality.
Medium Impact Industry Zone Code
The proposed Indoor Sport and Recreation use has been assessed against the Purpose and the
relevant Outcomes sought by the Medium Impact Industry Zone Code and within Table 7 below.
6.5.2.2 Purpose and overall outcomes
(1) The purpose of the Medium Impact Industry zone is to provide for :
(a) medium impact industry; and
(b) other uses and activities that—
(i) support industry activities; and
(ii) do not compromise the future use of premises for industry activities.
(2) The overall outcomes sought for the Medium Impact Industry zone are as follows:
Venture Drive Enterprise Precinct
(a) Development may accommodate some Theatre uses (filmmaking studio or music
recording studio) and Sport and Recreation uses where adverse off-site impacts are
avoided and the use—
(i) is compatible with surrounding industry uses; and
(ii) does not compromise the ongoing operation and viability of industry activities
nearby and within the Medium Impact industry zone;
(b) Offices are trade related only and do not compromise or compete with the Noosa Shire
Centres Hierarchy.
RG Strategic Town Planning Report – Indoor Sport and Recreation 15
Page 18
Comment: The proposed pilates studio is located within an existing industrial tenancy and will not
compromise the ongoing operation and viability of industry activities nearby.
The proposed development consists of the reuse of an existing tenancy and no expansion of the
building is proposed. No external works are proposed to the built form and therefore the use will
have no impact upon the existing visual amenity of the area.

The proposal has been assessed against the codes within the Works Code. The proposed use is
consistent with the developed character of the locality and is sited on land that is suitable for a
pilates studio. Standard water, sewer, electricity and telecommunication connections have been
provided to the subject site. The site is accessed via existing pedestrian, cycle and vehicular
infrastructures which connect the site to the surrounding residential communities. The site is easily
accessible at all times.
All pilates classes will be held within the studio and suitable day and night safety and security
measures are provided through means of signage and lighting. The existing carparking
infrastructure sufficiently meets the demands of the proposed pilates studio as demonstrated in

This report has been prepared by RG Strategic to accompany a Development Application made by
KX Pilates (the applicant). The applicant seeks a Development Permit for a Material Change of Use
for an Indoor Sport and Recreation use at Unit 1, 8 Venture Drive, Noosaville 4566.
This report demonstrates that the proposed development is permitted pursuant to the provisions of
the Planning Act 2016 and the Noosa Plan 2020, and the proposed pilates studio can be supported
on a number of grounds, including:
• The development complies with the intent of the Noosa Plan 2020,
• The development is consistent with the overall outcomes for the Noosaville Local Plan
Code and does not impact on the hierarchy of centres,
• The site is well located in the Venture Drive Enterprise Precinct of the Medium Impact
Industry Zone of Noosaville, and is well connected to the existing pedestrian, cycle and
public transport routes,
• It has been demonstrated that the proposed change in use to an Indoor Sport and
Recreation use only requires a minor reconfiguration of the existing car parking
including new line marking and relocation of the waste storage bins. The limitation of
participant numbers have been proposed to ensure sufficient parking is provided to
meet the reasonable requirements of the land uses.
• The proposed pilates studio is occurring in an existing building and will not negatively
impact on the industrial nature of the area and existing and future industrial uses, and
• No new buildings or alterations to the existing built form is proposed on site.
For the reasons above it is recommended that this application for Development Permit for a Material
Change of Use for a Pilates Studio (Indoor Sport and Recreation) at Unit 1, 8 Venture Drive,
Noosaville 4566 be approved subject to reasonable and relevant conditions.
