GENERAL COMMITTEE MEETING AGENDA 19 APRIL 2022
The proposed building envelope provides a 25metre setback to vegetation is indicated as satisfying
relevant Bushfire requirements. A 20 metre fire break trail is also proposed around the building
envelopes of the site which will provide continuous access between lots for fire fighting vehicles.
The applicant proposes that unlocked gates will be provided between boundaries of each lot to
enable access for emergency vehicles. Concerns are raised with this approach as overtime
landowners may lock the gates or the gates may fall into disrepair and there are limited
mechanisms available for monitoring and maintenance of this private infrastructure. As the fire
break trail is likely to be used in emergencies it is considered that the trail should not be fenced
and a condition has been included in this regard. It is also considered that the easement terms
also permit access to other lot owners for maintenance reasons.
Vegetation Protection Covenant
Councils Environment Officer has reviewed the Rehabilitation Concept Plan for the site that details
the proposed rehabilitation methodologies including weed management and revegetation. The
species selection and density is considered appropriate however the Performance Criteria is not
considered detailed enough and is not a long enough period to determine the success of the
rehabilitation. Conditions are recommended to be included to address these issues.

4.3 Other Referrals
The application was forwarded to the following external experts for review and/or comment:

5. CONCLUSION & REASONS FOR DECISION
The application seeks approval to reconfigure the existing site into 8 rural residential lots. The
layout reflects the flooding, biodiversity and bushfire constraints of the site with these areas
covered by an environmental covenant and bushfire access easement. All lots have designated
building envelopes that are located above the 1% AEP flood level, with future dwellings to be
constructed above the Probable Maximum Flood (PMF) level to facilitate the capacity for future
residents to seek refuge in place.
The proposal however has not adequately demonstrated that it can comply with the provisions of
the Flood Hazard Overlay Code that relate to Disaster Management. Further information
concerning an assessment of the level of this risk and impacts on the site and general community
are recommended to the provided and the recommendation is worded accordingly.
