Information Request MCU21 0009
Officer: Patrick Murphy Direct Telephone: 07 5329 6436 Our Reference: MCU21/0009 Your Reference: 20200308 25 February 2021 RWT Darlington C/- Adapt Town Planning + Development Management PO Box 7618 SIPPY DOWNS QLD 4556 [email protected] Dear Sir/Madam Information Request Planning Act 2016 I refer to your application and advise that Council requires further information to satisfactorily assess the proposal. application details Application No. MCU21/0009 Street Address: 7 Berrima Row Noosa Heads Qld 4567 Real Property Description: Lot 132 RP 88934 Planning Scheme: Noosa Plan 2020 (25 September 2020) INFORMATION REQUIRED The information requested is set out below: Issue 6.3.3.2 (2)(a) of the High Density Residential Zone Code seeks that high density residential neighbourhoods are predominantly home to permanent residents. The application material has not addressed the prevalence of short-term accommodation within the surrounding area and whether the neighbourhood is predominantly home to permanent residents. Information Required A review of accommodation types within the surrounding area to clarify whether to proposal meets 6.3.3.2 (2)(a) of the High Density Residential Zone Code. Issue It is to be noted that the application material states that it is intended to use the dwelling house and secondary dwelling as two separate suites on a year round basis. However the layout of the building suggests the possibility of at least three individual areas to be rented for the purposes of Short Term Accommodation. This opinion is formed on the basis that the building includes 3 laundries and at least 3 separate areas where food can be prepared. Information Required Plans amended to clearly identify the 2 separate areas proposed to be used for short term accommodation. Clarification of the number of persons proposed to stay in each separate area. Location of bin storage within the site, noting that waste storage and disposal facilities must be provided in accordance with Planning Scheme Policy 9, Waste Management, including an external imperviously paved area correctly sized for all refuse and recycling containers and suitably screened from public places and neighbouring properties. Issue It is also to be noted that the building approval for the original dwelling was subject to siting variations based upon the approved use (i.e. Detached House). The change of use to Short Term Accommodation could create further reductions in amenity to neighbouring properties. Please note that the proposed swimming pool does not have any approval, in particular for reduced setbacks. It would also appear that the existing dwelling was finalised without reference to the recent amended referral agency response that was issued by Council, so there is no verification that the additional building work required for this existing development was completed. Information Required Clarification as to how the amenity of the adjoining residences will be preserved including but not limited to: Details of the times which the outdoor areas are proposed to be used. Clarification as to why the pool has been shown on the plans, if it is not intended to developed the pool then the pool must be removed from the plans. Clarification that all works required by RAB18/0152 have been completed. Issue The Driveways and Parking Code prescribes the following rate for car parking for Short Term Accommodation: Dwellings — if a small dwelling—one covered space up to two bedrooms and two covered spaces for three or more bedrooms; and if not a small dwelling— two spaces; and one space per four dwellings. Accordingly 3 covered car parking spaces are required in addition to a further one car parking space. The proposal does not satisfy this requirement as it is proposed to provide 2 covered car parking space and one additional space. Furthermore it is unclear how the car parking proposed will function. Information Required Provide the required number of spaces. Provide swept path plans demonstrating how vehicles will enter, access the parking and then exit the site. Please note the vehicle paths must assume that the other spaces are occupied. Sight lines and potential for conflict for vehicles entering and exiting the site noting that an existing retaining wall and steep slope of the driveway are likely to impede sight lines for vehicles entering and exiting the site. Issue A review of the building approval record and associated final inspection certificate, identifies the building as a Class 1a Dwelling and Secondary Dwelling. Due to the layout of the building, with a sole-occupancy unit located above another, it is our opinion that the building classification should be Class 2. The reclassification of the building will require a development permit for building works, with the fire separation requirements and any other associated building provisions will be considered at this time. The issue relating to the number of dwellings, detailed above, could impact the fire separation provisions. Information Required Clarification of the capacity for the existing building to be used for the proposed Short Term Accommodation, particularly in relation to any fire separation requirements. Clarification of any works which will be required both internally and externally to accommodate reclassification of the building, with plans amended accordingly. due date for response to information request The due date for providing the requested information is 25 May 2021. Please advise Council of your response to this information request in accordance with section 13 of the Development Assessment Rules.
