showing the location of the property.

Noosa Plan Zone: Rural Residential
Overlays: Land Subject to Acid Sulfate Soil - Above 5m AHD to 20m AHD
Biodiversity — Area of Biodiversity Significance

Flood Hazard — Flooding & Inundation Extent

SE Queensland Regional Plan: Rural Living Area.

1.2 SITE DESCRIPTION

The subject property is located at the south-western intersection of McKinnon Drive
and Little Creek Road at Cooroibah. The property contains an area of 4.002ha.

The property is used as a rural residential premises with a dwelling house and sheds
standing adjacent to the southern boundary.

The property is generally flat and has been generally cleared of treed vegetation in
the past.

Power and telephone services are connected and available to the property from the
Little Creek Road frontage.

Both McKinnon Drive and Little Creek Road are good quality bitumen roads. A
driveway is located centrally along the Little Creek Road frontage, which provides
ingress/egress to the local road network from the property.

The adjacent properties to the property range between 0.65ha and 4ha.

2. PROPOSAL

It is intended to carry out a Reconfiguration of the property to create 2 Lots as shown
on the Plan of Proposed Reconfiguration (Ref: 21-5409AA contained in Appendix B).

The new boundaries of the proposed Lots are located along an existing fence line
that bisects the property.

The proposed new Lot 30 at the western end of the property contains the house,
shed and pool and comprises an area of 1.742ha. The existing driveway and effluent
disposal area are located within the confines of the new Lot.

The proposed new Lot 31 at the eastern end of the property is generally vacant, with
the exception of 2 small rural sheds located adjacent to the south-western corner,
and comprises an area of 2.26ha.

A house site area is proposed adjacent to the south-western corner of proposed Lot
31; with a proposed driveway to be constructed adjacent to the existing access to Lot
30. The proposed Lot 31 contains sufficient area for a house site, effluent disposal
area and driveway.

The existing electricity and telecommunication services located along the Little Creek
Road frontage will provide services to both Lots without extension of the reticulation.

The proposed new Lots reflect the character of the local area.

3. STATUTORY ASSESSMENT — STATE GOVERNMENT

3.1 State Planning Regulatory Provisions

The site is included within the SEQ Regional Plan State Planning Regulatory
Provisions — Land Use Category of Rural Living Area; therefore no further
assessment is required.

3.2 Referral and State Development Assessment Provisions

The land fronts McKinnon Drive; which is a State Controlled Road; therefore, as the
McKinnon Drive frontage is within 25 metres of a State Controlled Road, it is
considered that the application will require referral to SARA as a concurrence
agency.

The development does not propose any new access points into the property from
McKinnon Drive.

3.3 State Planning Policies

The site is not mapped as being affected by any of the State Planning Policy’s State
interest

Page 4

4. NOOSA PLAN 2020
The subject lands are located in the Rural Residential Zone.
The subject lands are affected by the following Overlays of the Planning Scheme:

e Land Subject to Acid Sulfate Soil: | Above 5m AHD to 20m AHD

e Bushfire Hazard: Medium Potential Bushfire Intensity
Potential Impact Buffer

e Biodiversity: Area of Biodiversity Significance

e Flood Hazard: Flooding & Inundation Extent.

The above overlays do not affect the level of assessment of the application.

The proposal has been assessed against the relevant codes including: The Lot
Reconfiguration Code, the Rural Residential Zone Code, the relevant overlay codes
and the relevant development codes. The aspect of the codes that does not comply
with the Acceptable Solutions is discussed below.

4.1 Reconfiguring a Lot Code

It is considered that the proposal complies with the Overall Outcomes of the Planning
Scheme for the following reasons:

e The proposed lots are appropriate with the intended use and the character of
the local area.

e The proposed Lots are responsive to the site constraints.
¢ The proposed Lots have services available and include safe access.

e The proposed lot areas comply with the minimum prescribed areas and
frontages prescribed in the Planning Scheme.

e No modification of the site is required.

e The proposal is a logical development of the property.

Page 5

Overlay Codes

Specific Outcomes and Probable Solutions of Land Subject to Acid Sulfate
Soils Overlay Code

The proposal does not require any site modification of significant works; therefore,
the proposal has no impact upon the acid sulfate soils.

Specific Outcomes and Probable Solutions of Biodiversity, Waterways and
Wetlands Overlay Code

The new Lot boundaries created by the proposal transect areas cleared of treed
vegetation and are located along existing fence lines. The proposal has no impact
upon the areas mapped as having biodiversity significance.

This assists with the conservation of the sensitive areas and avoids any
fragmentation of the environmental values.

Specific Outcomes and Probable Solutions of Bushfire Hazard Overlay Code

The proposed Lots contain an area designated as Moderate Bushfire Hazard along
the western boundary. The existing dwelling and the house site area are located
outside of the hazard area; therefore the development does not increase risk to
people or increase the severity of any risks.

Specific Outcomes and Probable Solutions of Flood Hazard Overlay Code

The proposed Lots contain areas designated as Flooding and Inundation Extent
along the Little Creek Road frontage. The proposed Lots provide flood free areas
that are suitable to support a house site area and an effluent disposal area; and act
as an area for congregation and refuge.

Whilst Little Creek Road and McKinnon Drive are mapped as being within the
flooding and inundation extent area, the roads remain trafficable in DFE due to the
depth and velocity of the water. Therefore, the development does not increase risk
to people or increase the severity of any risks.

5. CONCLUSIONS

The planning assessment has been prepared to accompany a code assessable
application for a Development Permit for Reconfiguration of Lot 3 on RP211638 to
create 2 Lots.

Page 6

The assessment concludes that the proposal complies with, or with the imposition of
relevant conditions, the relevant provisions of the applicable codes in the Noosa Plan
2020; therefore,

it is recommended that the application should be approved subject to reasonable
and relevant conditions of approval.

| look forward to Council processing the application. Do not hesitate to contact this
office if you have any queries.

Yours faithfully

Max Watterson
