Good afternoon, 


We currently have an application for the demolition of the existing dwelling and construction of a new dwelling at 97 Cooks Rd, Tinbeerwah. 

The proposed allotment, and adjoining lots are mapped in the Agricultural Land Conservation areas. AO8.5 of the Rural Zone Code requires the following:


It is my opinion that the sensitive land use, being the dwelling house use, is already established with the existing dwelling and the replacement dwelling shares these existing use rights. The existing dwelling is already constructed within 200m of an adjacent lot and the proposed dwelling will be constructed in generally the same location and slightly further from the adjoining boundary (see below image & plans attached). 

I believe that the proposal satisfies the Acceptable Outcome 8.5 in this instance as the proposed dwelling is replacing an existing dwelling and a MCU application is not required. Could you please provide Council's opinion regarding this matter? I would be happy to lodge an exemption certificate as a formality if this is determined to be the best course of action.
