8.0 CONCLUSION

This Town Planning Report has been prepared to support a development application for Material
Change of Use for a mixed use development, comprising a tavern, liquor barn, shops, education and
residential units at 99 Noosa Drive, 3 & 29 Lanyana Way, Noosa Heads, described as Lot 3 on
RP884396, Lot 54 on RP139776 & Lot 2 on RP889596.

Under The Noosa Plan the site included within Noosa Heads Locality with a zoning of Business Centre
(Lots 2 and 54) and Community Services (Lot 3). The proposed uses are defined as Entertainment and
Dining Business Type 3 Bar, Retail Business Type 2 Shop & Salon, Commercial Business Type 1 Office,
Education Type 3 Adult and Multiple Housing Type 4 Conventional. The application is subject to impact
assessment.

Planning support for the proposal is justified on the following grounds:

 The proposal is supported by the Noosa Junction Placemaking Strategy and will deliver the key
    outcomes identified for the site by the Noosa Junction Placemaking Master Plan at no cost to
    Council or the community;
   The proposal will provide a positive contribution to Noosa Junction;
   The proposal is supported by community need and benefit;
 The proposed development can be achieved with no detrimental impact on the existing
    environment and locality amenity;
 The proposed use and development form, scale and character is consistent with and compatible
    with the surrounding Noosa Junction business centre zoned lands;

   The proposal does not conflict with The Noosa Plans desired environmental outcomes;
   The proposal complies with the overall outcomes for the Noosa Heads Locality;
 The proposal generally complies with the applicable planning scheme codes. Where the probable
    solutions of the codes are not met, compliance with the specific outcomes has been demonstrated,
    with the exception of outcomes relating height and uses within the Community Zoned part of the
    site;
 To the extent that there is any conflict with the planning scheme, the conflict must be minor and or
    of a technical nature and in any event there are sufficient grounds that will overcome the conflict.

Approval of the application is warranted.
