IV. confirmation the contact person is responsible for the premises including addressing complaints
and visitor queries.
Section 4
Section 4 is the additional criteria for granting the approval. This is the criteria that Council uses to assess the
application. For approval all of the criteria must be met.
(a) The applicant must be the owner of the premises. A third party may submit the application on the
owner's behalf but the owner's signed and written consent and full details must be provided. In all
circumstances the approval holder will be the owner of the premises.
(b) This ensures the operation of short stay letting of the premises can be lawfully conducted. This confirms
that either a development approval has been obtained, the premises has existing use rights or the
premises has been assessed to meet certain ‘accepted development subject to requirements’ (self-
assessable criteria) in the draft New Noosa Plan. For further details refer to Councils Fact Sheets or
frequently Asked Questions.
(c) Ensures the premises can operate in accordance with the conditions ordinarily imposed on a Local Law
approval.
(d) The Local Law has the ability to cancel or suspend an approval. This provision means if the approval has
been cancelled within the last 2 years then the required yearly approval for short stay letting will not
be granted and therefore the use cannot operate. The provision mentions section 17 and section 19
which identifies the process that Council is required to follow to cancel or suspend an approval. Section
17 and 19 can be found in Local Law No.1 which can be accessed here.
(e) If within the last 2 years, 3 or more fines have been issued because of breaches of the conditions of the
Local Law approval for short stay letting, then the required yearly approval for short stay letting will
not be granted.
(f) Ensures the operation of short stay letting has complied with:

ll. | the maximum number of occupants® is the total number of bedrooms multiplied by 2 OR 12
occupants whichever is the lesser. For example, a 3 bedroom premises could have a maximum
of 6 occupants;
* It is important to note that the definition of occupant is anyone that occupies the premises
including visitors.
ill. this provision ensures the operation of short stay letting will not negatively affect surrounding
residential amenity;
IV. all vehicle parking must be on-site.
(g) These provisions are to ensure that a contact person has been nominated, and that person is
responsible for the premises 24/7.
